If Sisu could sue the council for damages based on the council loan to ACL, surely ACL could sue for damages over the high profile lack of rent payments? They could argue they'd have attracted more business without the negative stories put out that they were teetering on the brink etc. Either...

I guess ACL would just go to a commercial lender and borrow the money to pay the council back and we're still no closer to a return to the city.

I can't say that it does without being a hypocrite really as my tenants are paying the mortgage on my flat. One of the things that I don't understand is why SISU didn't just buy the Higgs share which would have given them a third of the seats on the board of ACL and therefore a say in things. It's not like they weren't willing to sell their share, can't wait to offload it by all accounts and the club...

Only because of the actions of one tenant not paying their agreed rent which I think is what the Judge said in his summary of the first Appeal Application wasn't it?
