If there is any doubt over whether it's on or not SISU, or their representatives, will be there. There will be a lot of money spent tomorrow on 2 sets of solicitors and 2 sets of barristers (money which could fund a new striker).

If it was written in the original agreement it would be considered to have already been agreed with ACL. It is a standard inclusion in many agreements such as collateral warranties and commercial rental agreements.

In the business world it happens all the time. You'll normally have a holding company that owns all the assets and operating companies underneath which are exposed to the risks of business. If one of the businesses catches a cold somewhere it is closed down without affecting the other...
