Wasn't the rent set at a time before SISU? Should have done due diligence diligently, I think.

Maybe so, but it the rent had to be pegged high in the first place because of the loan.

First interruption from the judge. CCC QC a lot louder and sounds more like a QC should. Which means nothing to the result of course...

CCC QC refers to Sisu rent & licence fee strike creating situation in which ACL was under v. real threat.

Council took action to divert that threat.

The council was where it was in Dec 12-Jan 13 and had to respond to bank pressure

SISU QC may say these things, but it doesn't mean it is true. Don't forget the judge will hear both sides and come to his own conclusion which may well mean disagreeing with SISU and their lawyer. I think you have an agenda and are bending the facts to push your agenda.

Judge questioning which CCFC company was liable to ACL. CCC QC seems unsure. Lots of muttering at the back now. CCC QC gave wrong info. Sisu QC being questioned and giving correct info.

Oops for CCC QC. First mistake!

Council QC says it acted within its “wide parameters of discretion” with regard to state aid.
One of ACL’s income streams was its rent and licence fees “which Sisu bought into with eyes wide open.”
Sisu created a situation in which ACL and the council’s interest in ACL were under threat

Council QC says there are two brief answers to Sisu’s case. Council was not obliged to do a deal with Sisu. Council did explore deal with Sisu but it never came off.
In January 2013 council had to act.

Why did it have to act if there was an offer on the table from YB. That is the question.

Council QC points out ACL has kept up to date with the loan for the last 18 months.

Yes. Still take the opinion and interpretation with a pinch of salt. "ridiculous" was not a quote from the judge and he is not obliged to accept SISU's QC's opinion.

@TheSimonGilbert: Coun QC says there was no conflict with directors of ACL also working for council as officers were used to provide advise.

@TheSimonGilbert: Club QC accuses Sisu of ignoring fact ACL and charity are not the council and lumping everyone's views in together.
