Ben stokes could be in more trouble than I thought!

Affray is taken pretty seriously and you usually end up in court. I got done for it back in my youth over some trouble in Leicester, only got a caution for it which basically meant I'd have probably got let off if it had gone to court.

I think the NT lad was the one who threw the glass and has the longest sentence, 16months I think.
The Cov lads barrister didn't attend so Is still to be sentenced, might be pulling a flanker there.

However, you're not allowed to chase someone down and give them a kicking, even if they've just assaulted you or one of your friends. At that point you're clearly not under threat and therefore you don't need to defend yourself. Affray is a more serious offence than assault, as I recall, because it relates to the likely effect on innocent bystanders.

I'd be amazed if anyone who just pushed over someone who was clearly threatening them would even get to court, let alone be sent down, but the police do get it wrong. It would be interesting to know what the evidence in front of the court was...

Trust me mate, it happens. As I say, my mate was in court for the Portsmouth trouble and I was in court watching. Some lad got put down for pushing someone, he didn't push them over, he just pushed them with one hand!

And that sums up a lot of the judges we have in this country. I know a Cov lad who's serving time, admittedly for doing something very stupid, but you see lots of cases far worse where the culprits have half or less of his sentence.

Think there's even a bit more info and background in the updated article.
It's clear the judge sees the intervention and lack of going to the aid of the injured Mr Marsh as the Issue .
Then sees them as the aggressors In the aftermath.
So Imagine what may have happened If they'd backed off.
He's on a strange Planet from my POV ,a place where alcohol consumed, not Church mice.

If they want a fight fair enough but not in a social club.
Plenty of waste ground around and do what the Russians and Poles do, beat the crap out of each other on fields miles from anywhere. But the lads involved at the Buffs never knew anything about a prearranged scrap. I remember in the 70's many a scrap in the park next to the ground, but if you were there it was because you knew it was going to kick off, so that's the difference !

This pisses me off so much. The summer before this one me and a couple of mates got jumped out of nowhere on the way home from a night out. I was knocked unconscious instantly as I didn't even see them coming before one bloke smashed me in the face. I was stamped on the head when I was on the floor and the next thing I know I am in Walsgrave.

One of my mates got the reg plate of the van they drove off in, and we had two witnesses, but it still took the police one month to track them down and then asked them to make a voluntary statement. They got their story together and 24hours later came into the cop shop and told them that we started it. The police then dropped the case.

Here someone pushed someone over who was going to bottle someone and they are the ones that get sent down. What the fuck??

It makes you lose all faith, it really does.

That's the thing. If people want a scrap let them go and do it out of the way where no bystanders will get hurt and the only people there are people who want to be involved.

I’m always in two minds with stuff like this. On the one hand, don’t get involved as it’s a load of old nonsense. On the other hand if a glass come flying at me or anyone I’m with there is going to be a response. Easy to say don’t chase them down after and pile in, but in the moment it’s very likely to happen.
This seems as though it’s a classic making an example of football supporters. As has been said, if this happened exactly the same in town I highly doubt time would have been as harsh, if at all.

Used to see it every weekend in town and people would hardly ever got arrested for it let alone sent down.

I dont tend to get hammered at football but things like this are a bit offputting. Could potentially end up going out for a couple of beers, somebody else kicks off and you end up being sent down for it.

If he alone or as part a group used or threatened violence against another individual or group, then that might happen. That's pretty common in these situations when you think about it.

With all due respect though, the court balances the evidence presented so it's not just down to the police. Just pushing someone on its own wouldn't be likely to result in any offence serious enough to merit a custodial sentence, imho.

If he was threatening to do worse though, or was part of a group that was, then that might explain it. I'm not trying to make a call on the rights or wrong of this individual case here though mate, just working through how it can happen. Best advice I can give to anyone is don't get involved, no one gets arrested for walking away...

Could be mate, I honestly couldn't be certain. Fwiw, my experience tends to be more like yours, in that more people tend to get away with it than are caught for it.

The only observation I'd make is that in this case the Judge seems to have made his decision on the basis that the Cov lads involved chased down the Northampton lot to have it out with them. There's no way that self-defence is going to work in that case, and because there are other people around (including children perhaps) I'd guess it makes it affray a fairly easy charge to make stick, and a serious one too.

Like I say, I'm not the judge here and I don't pretend to know all the facts. And regardless, none of this makes what happened to you right. I just don't get why anyone would want to do this to someone else at random, but I know that it happens. I think the only thing I can offer is that people like this often end up coming off on the wrong side of it at some point (a.k.a. what goes around, comes around). Here's hoping, eh.

Do you know how often a number plate can change hands in one day? Just saying as have some knowledge of selling cars? Not always as easy as it seems. How long does it take to get a story together?

Self defence is a defence built on shifting sands. Forget reality of life and emotion you have to account for every punch and action. The threshold for defence and aggressor are fine. Then affray is a great catch all.

Not conkers! :emoji_laughing:
The first two were with cyclists that ride along the pavement near where I live. There's a ferkin' "No Cycling" sign as well but they still abuse the law. I've almost been mown down on a number of occasions and now when these lycra-clad twats come along, I get in their way and shout "Use the f**kin' ROAD!!" (or similar pleasantries!) Two occasions, these twats got off their bikes to "have a go" at me, but both times, they ended up on the paving slabs! One even said to me as he tried to get up, "Jesus mate, I didn't expect that!" He actually apologised and took his bike to the road and rode off. The last time was just after Christmas (a couple of months ago). A new neighbour's "boyfriend" was allowing their Staffy to shit under my front room window, so when I caught the bloke just leaving it, I went after him. He was a big c**t and he thought that as he was younger than me, he'd scare me away! Ha! Wrong! He went down like a sack of spuds and I told him to his face as he was lying on the ground, that if he allows his dog to shit again, I'd rub it in his face after I'd posted it through his letter box. His Staffy was just wagging his tail all the time! I've not seen any more dog shit since, either!

he was in the west end and pushed a Portsmouth supporter who had invaded the west end and squared up to him.
I was shocked but it opened my eyes to how corrupt the whole thing is.
Like I said in an earlier post, there was some sort of dispute between the club and the police over the category of the game and these lads got caught up in the ensuing pissing contest.
If you did what they did to someone in the street they wouldn't even bother with it.
The whole thing was caught on police video so it was clear for everyone in court to see. You sound sceptical mate and I don't blame you, if I hadn't been there at the time and then watched the rerun I probably wouldn't of either.

But just look at the sentences handed out for this trouble with Northampton and look at some of the stuff in the news where the perpetrators get lesser punishment.
