ACL will have enough votes to reject deal at creditors meeting

Probably not, except there's no such thing. There may be other routes out of admin, but it's the Administrator's first duty to save the company as a going concern. Could it be that this forces him to consider an alternative?

Trust to meet the Football League

The doctor says it's 50/50, but there's only a ten percent chance of that. ;) Anyway CJ, any news from the FL? Hope springs eternal.

ACL will have enough votes to reject deal at creditors meeting

This is down to the unconnected creditors rule. SISU/Otium are connected creditors because they are linked companies, so even though they've somehow managed to lard £60m of debt onto a non-trading subsiduary, they don't get the final say on the CVA because ACL are the main unconnected...

    Even more players to go.

Just my opinion, but these cuts look more about reducing the wage bill than removing dead wood (with the possible exception of Clarke, unless he signed a new contract last season?). Such is life, I suppose. I appreciate we need to pay within our means, but I do wonder at the logic of cutting...

    The Football League's Insolvency Policy

Great blog post, many thanks. It does rather make one wonder about the competence of the Footbal League. I've seen a number of posters here who when asking questions of the FL are simply directed back to their published rules. Like you say, it's pretty difficult to know whether SISU/Otium...

    CCFC staff letter

Always good to have a lawyer on board, but isn't this exactly what Fisher is talking about in his letter? A transfer from Holdings to Otium. "The purpose of this letter is to let you know that it is accordingly intended that your contract of employment will transfer to Otium, which is the...

    CCFC staff letter

Hmm. There is a lot of legislation around TUPE, particularly with regard to consultation. Off the top of my head, I don't think this letter covers it properly, but there may be more to come. In particular there's something about the right to consultation that sticks in my mind, there's a...

    CCFC staff letter

Take your point, but an employer can't sack you for asking about details regarding your employment. That really would get them in front of a tribunal!

    CCFC staff letter

If he works for CCFC Ltd, then very dodgy I would think, given it's under the control of the Administrator. If he thought he worked for Ltd, then I'd ask them to provide evidence that he doesn't - contract of employment might be a start. If already a Holdings employee, probably not much to be...

Guy on twitter claims to have a reply from league confirming Otium have been rejected

Erm... Brendan Guilfoyle would have been ACL's Administrator, iirc, but I don't think he's their lawyer. As for the other stuff - no CVA required if paid in full, only three years rent required if lease broken etc. etc., politely, where are your sources? I've shared my research where I can...

Guy on twitter claims to have a reply from league confirming Otium have been rejected

Lord, talk about someone seeing what they want to see in an email. Otium might fail the FL test, but how he's drawn that they will fail from that email beats me. As for the exit from Admin, for Otium/SISU to win through they'll have to jump all of these three hurdles: 1) To exit via a CVA...

The chap in question is saying he'll have the email uploaded in the next hour... the tension builds ;)

Guy on twitter claims to have a reply from league confirming Otium have been rejected

No doubt we've had plenty of well-meaning dreamers, and shameless self-publicists, but looking through this chap's timeline on twitter he seems straight enough. Perhaps the FL have gone back to him first on the basis that he organised the petition? This would be good news, imho, and would...

    On CWR this morning

It took some courage did that - good on you and your colleagues for taking a stand. It might not of itself put a stop to SISU's daft plan, but it's another barrier to cross, and another indication to them and the FL that what they're proposing is a really, really bad idea.

    The new ground

Lovely. If only we had £45 million to spend, and we could pay wages and suppliers at Malawian rates, and build under Malawian construction regs then that would be spot on. That's assuming, of course, that we could get planning permission for it. And if we didn't already have a perfectly good...

    Liquidating CCFC Limited

Actually, I'm sure I remember somewhere where this has happened. Someone bought a big brownfield site, relatively cheaply. Then they sold some of it to retail, and amazingly enough even managed to get a fair wedge of local government and other public funding to cover a chunk of the...

    Liquidating CCFC Limited

I wouldn't doubt it's possible that SISU might want to move out there for a few years. But I think it's unlikely they'd either be able to sell it on after that for a huge profit, or be allowed to stay there and remain in the FL under current rules.

    The new ground

But they wouldn't retain the golden share if that was SISU's plan. The whole point of the FL rules is stop that happening again.

    Liquidating CCFC Limited

I'm guessing there's a reason that Nene Park hasn't already been bought by a developer, so I'm not sure how much profit you'd make. First you'd have to make the stadium fit for purpose, and then any developer would have to knock it down to build something else. Unless you were planning to stay...

    The new ground

I'm afraid you can't quite do that. They'd have to apply for planning permission in the same way as every other developer would, and would need to go through big hoops for a development of this nature. Judicial review is when you think a Council have made an unfair decision. The JR that SISU...
