You're supposed to be paying attention in there mate. How can we give you a kicking if you're just going to talk about cricket all day. ;)

50% of ACL and one would presume scope to influence its future direction and growth, the rent & charges, and access to income streams from that business.

Was that ever established? I thought the formula price was actually around £6.5m. Regardless, it looks like Higgs were prepared to accept £5m, but not on SISU's delayed payments terms. It's a pity SISU didn't start negotiating about it from the off in 2007, imho, instead of gambling on...

Spot on. Couldn't agree more. Fwiw, I do get a sense that fans (including myself here) are beginning to see this now.

Hi Lord, Count here. ;) I think it's pretty well established that there was always the option for CCFC Ltd to buy the Higgs share at a formula price. For whatever reason, SISU chose not to exercise the option... (Please don't make me google it though, I'm knackered. For once, just trust me...

I'm not convinced it was doomed to fail - isn't this the nature of every commercial landlord/tenant relationship. One side wants to pay as little as possible, the other side wants to charge as much as possible. Neither side, typically, wants to break the other though. As an aside, this...

Anyway Rob, what was your impression* of the court case? It didn't sound like the judge was entirely convinced, but then I'm not there. *I'm sorry I don't do impressions, my training is in Psychiatry. :) http://www.youtube.com/watch?v=x4MaUIk0Thc

I'd largely agree with this, for what it's worth - but I think the obvious and first thing to do is to come back to the Ricoh on a short-term rent deal whilst the longer and far trickier issue of ownership is thrashed out. For SISU to say that they can't do that because they don't trust the...

In truth though Rob, there was never any pressure from your campaign on SISU to talk about a rent deal, was there? You focused solely on the council, from what I saw. And indeed it seemed to fail to recognise that whilst the very court case which you are watching now was threatened, it would...

But he did say that the trustees weren't involved in a conspiracy, didn't he, which shot down a fair part of SISU's case. It also leaves it a bit light on the conspiracy argument, leaving ACL as the only other possible party, who of course are 50% council-owned. And again, there's no way to...

Just because the Judge appears to be being harsh to the SISU QC, I wouldn't take bets on the outcome of the case yet. It's just as likely he'll tear apart any flaws he sees in the Council QC's argument. I sense it's just what Judges like to do. ;)

Yep, that's fair enough - although again, I can't see where the evidence is that there was a deal to shoot down, given there was clearly no agreement on price or more clearly how it was to be paid. Regardless, you've got to accept the judge's take on this, given. As for negotiation on all...

Quite. If the rent's paid, or even a lower rent agreed (as was, supposedly, being negotiated), then there's simply no way to replace SISU as owners unless they chose to sell. You can't force someone into selling the club, even via admin, unless they refuse to pay their bills.

    Judicial Review thread

Erm... at what point did the council veto the deal? What I took from the Higgs case transcripts is that the deal fell apart because SISU offered £5m on buy-now, pay-later terms without any security that Higgs could accept. I didn't see any evidence of the Council shooting down the deal, in...

We've been here before. Many, many times. Even SISU seem to accept that the level of the rent was related to the amount of the mortgage. Hence the plan to buy out the mortgage, rather than just lobby for a rent decrease. Either way, it's old news, surely.

Always get your retaliation in first, Rob. Appeal for everything, nick a yard everytime the ref's back is turned, and nail the goalie at every opportunity. That's I'll I've ever asked for. ;) OSB is an anonymous fan here like almost everyone else. If there's an issue with what he says...

That's not what I'm saying and you know it. He's made the mistake of suggesting that someone who posts an opinion that he does not agree with works for the other side. It's common enough, that, and unworthy imho.

I don't think that's ever been denied. However wasn't the sliding scale proposal turned down (edit: by the club). I guess we'll see. In the meantime, what were SISU doing about it from when they bought the club up until the roadmap/rent strike?
