If it turns out the council win and the whole aim of JR was just for sisu to mudsling I'm going to be well out of pocket having a couple of times fallen for 'put your money where your mouth is' when explaining kcic view that sisu will win because to have pursued it for over a year including successfully appealing against the original rejection they must surely have thought they'd win

If everything said in court is fact then SISU thought ACL was worth nothing but offered 2 million for half of it because Higgs are a charity. FACT.

Seems like ages since SISU used the offal as their mouthpiece. Shall have to wait and see if it is as unbiased as last time

This won’t be so much about the decision that Justice Hickinbottom arrives at as the information that gets read into court. Sure, a decision on whether the council acted within state aid regulations will be useful and could have an effect on resolving this dispute but the main event will be hearing what is read into court re: emails & documents between the various parties connected to ACL.

There could be grounds for civil actions after the hearing and I’d bet dollars to doughnut holes that there will be an appeal from whichever side loses.

No matter what people might try and make out about how boring etc. it is, this will be one of the main outlets for actual information about the background to this whole saga.

There will be a lot of legal back & forth and it can be hard to follow from the public area as you don’t get to see any of the documentation being referred to until it is released (usually after the case).

So as you say Rob the main event is what has been said, I'm really looking forward to hear what other council employee has been singing 'Sisu out' or what important Coventry figures have been tying deflated balloons on cars.

The one worry I have in all this is that the people of Coventry suffer either way, either by debt being loaded against the club from all this or money taken from the council coffers thus preventing it going where it should.

Both parties, Sisu and Higgs had no appetite to complete the transaction for the Higgs share of Acl.

But Sisu have an appetite to prove this loan was illegal from ccc.

Even if sisu win they still won't get hold of the Ricoh.

Really hope this is the beginning of the end for Sisu with our club. They have been an absolute disaster and if they continue to own us there is only one consequence. We will cease to exist. They represent everything that is wrong with our society, never mind our club.
I would imagine they will try and cloud the important issues today, looking to pick targets for future litigation. It's what they do isn't it.
Squandering CCFC money on legal fees. Bang goes your new striker. New goalie.
As far as I can see, the Council, ACL, were protecting themselves from the obvious, rapacious tactics of a Hedge Fund operation. Whether they did that strictly legally, I don't know, nobody on here knows. But I would do it myself if it meant stopping Sisu getting their dirty hands on a site partly funded on tax payers money, for the people of Coventry and their football club.
I really do hope Sisu get what they deserve. Nothing.
Then maybe, we can get back to Coventry and rebuild our club without their shackles, their lies, greed, total absence of any idea of a community. Of integrity, they don't have any.

A big match maybe, but what is the competition?

1. The charity shield, a contest in which two sides go to a neutral venue to play in a match that might produce plenty of talking points but has little meaningful value except, maybe, providing a psychological edge in the season to come?

2. A European Cup qualifier, a prelude to more battles but a long way short of the final?

Or

3. The cup final, a contest which could mark a change in the club's fortunes and could potentially be the start of a new dynasty?

In reality, it is probably not number 3. And unless the contest hastens the return of CCFC to Coventry, the result probably doesn't matter a great deal.

I believe it is scheduled for three days, although you may have to wait longer for the result. And the losing side might try to force a replay.

It sounds like today is more for making CCC sound bad than anything. Is that why Joy wanted things that are irrelevant to be used? She certainly put enough effort into it.

And, hopefully, the FL will be watching today's events. Keeping track of Sisu's lack of action - re a new ground. Their actions and deceptions in court. See them for what they really are. Not 'fit and proper' by any stretch of the imagination.
I think today's court hearing is important. It may be about the simple point of whether the Council arranging a loan for ACL is legal, but the hearing will shape the next moves. That's why it is important.
Jeez, why do we have so much corruption in the 'beautiful game?' From Coventry to South Africa (where World cup stadiums are rotting already and the promises to local people never fulfilled), to Brazil (ditto), the fans get ripped off by Sisu, by Fifa, by the FA.

To be honest, from Thursday I couldn't give a toss for a bit because I am sick and tired of all this crap surrounding us. Going to enjoy the world cup whether we do well or not and the US Open starts then too

Hope that Sisu are shown up for what they are. A clear council victory is more important than any game we've played this season.

Legally neither.

The action is being taken by ARVO Master Fund, SBS&L and CCFC H. That's the names on the court documents, "the Club" are not on there

CCFC is actually "Otium Entertainment Group trading as CCFC" so CCFC doesn't actually have a basis in law as a separate entity to take the action as far as I can see.

CCFC H isn't even part of this JR action any more because it was dissolved as a company 03/06/14.

It is not the club taking this action it is the two stakeholders in Otium Entertainment Group Ltd. Is that a pointer as to who seeks to benefit or will benefit? - everyone can make their own minds up on that. :thinking about:

Legals aside however the reality is that because of the intertwined nature of things, it is SISU taking the action against CCC

So CCFC are not involved in the JR but they are using the offal to get what they want out in the open?

Will be interesting to see if they put anything where the judge picks them up on what he sees as untruthful or irrelevant or do they use it as it is said in the courtroom.

If the importance of this case is not the verdict but getting background information out to the fans then you would seriously have to question what case there is. The implication is therefore of it being an information exercise is that SISU are relying on changing public opinion to put pressure on the stakeholders in ACL. Of course we are told the purpose of such pressure is to do the right thing by the fans & taxpayers because SISU have moved on and are building their own stadium Really?

The verdict is important, if they get a verdict that means ACL repay the loan and CCC can not finance then it is vitally important to both ACL and SISU. You do not spend probably north of £1m on a PR exercise for the fans to understand the background better. ACL becomes vulnerable then and SISU would increase the pressure. If the verdict is that ACL and CCC are all above board then what ever influence desired on public opinion by SISU is weakened - both ACL and CCC could point to having been found to have done nothing wrong by the court. The reality is probably going to be somewhere in the middle of those two things.

Will stuff come out of a he said she said nature. Yes. However, like the judge, we would do well to concentrate on the facts of what actually happened and not stuff taken out of context or only partially included. No doubt a lot of information will be read in to the court, I suspect the Judge might stop some of it as not relevant to the decision made by the CCC regarding the loan. But disclosing he said she said opinion will change the situation how? We might think we know more about what has gone on but what actually, other than some opinions maybe, changes? What does it solve for CCFC?

Question "read in to court" - what does that actually mean? Does that mean it must be read out, referred to, simply listed that there is a document or does it mean the bundle of disclosure docs & skeleton arguments presented to the judge to pre read?

Unfortunately not today. Was on the train ready to leave last night and everything got cancelled due to someone being hit by a train and then my suitcase wandered off so I'm working on locating that! What fun...

Best post I've read in a long time. I couldn't agree more. The whole bloody mess we are in is as a result of mismanagement by all of the parties involved BUT I believe CCC/ACL made their decisions with good intentions (to protect a public asset and to protect CCFC by trying to force SISU out). They may have made mistakes - but as Spionkop says, I think most of us would have done the same thing.

SISU on the other hand made their decisions for personal gain only. They don't care about public money, they don't care about a failing football club, they don't care about the fans, they only care about themselves. Spionkop is spot on - they not only show what is wrong with football ownership, they show what is wrong with society and it really fucks me off.
