I have tried to follow the ins and outs of all the court cases over the last couple of years without completely understanding the laws of the land, but if my thinking is correct , the information put in front the judge in the JR case was incorrect.
AL has admitted that is the case , so how could the judge make the correct judgement ?
As i say my knowledge of legal matters is somewhat limited.

I can see the bit where she says she won't deal with sisu, now can you provide a link for where she says she won't deal with Ccfc?

I doubt very much that the judge made his judgement based on what AL had and hadn't said. He would make his judgment on the body of evidence provided by all parties involved in the JR from both side of the arguments. The case was complicated and like you I don't understand it fully but the outcome didn't hinge on what one person said. I understand that much.

Yeah, obviously she was meaning that time in the last 7 years or so when we were owned by somebody else.

Fuck me.

Ah OK, so were back to treating the club and sisus as a single entity now are we?

There is a world of difference between saying "I will never deal with sisu" and "I will never deal with Ccfc".

You know this.

In other words let's not let the truth get in a the way of a good old council bashing.

This is almost comedic now. The 'Smoking Guns' of the Judicial Review have now been replaced by 'The Pea-Shooter From The Council Meeting'.

Who is it written by? Someone who can't even spell Ann Lucas' name. And what was the context? For example; was the question something like 'SISU are now demanding unfettered freehold of the Ricoh', to which she stated 'hell will freeze over...'? Because, as we all know; selling the freehold, as demanded at one point by SISU, was never within the council's gift.

Has anyone read the Judicial Review findings? Have people forgotten the club's owners moved the club to Northampton? Is there not a new stadium being built?

There are so many 'official experts' on this site on either side of the arguement I am not sure why you are suprised at the comedic element of it all.

Re the 'Hell Freeze Over Comment' it may have been re SISU it may have been not. You dont know I dont know, people who were there may know. It interests me thta now this quote is in the public domain, and has been quoted in several publications and on here many times, Ann Lucas has never refuted it nor has taken any action re slander. It doesnt prove anything but points in the direction that she may well have.

Re a Smoking Gun, I dont want to be harsh but it only appears you or Tony seem to use that phrase now, perhaps it is a homage to both your love for Les Reid?

I use it because I remember back to before Judicial Review, and the promises of what would be 'outed' by Reid and the feverish anticipation of the anti-council lobby on here. This is all evidence presented by all parties, of course. I also like it as it's independent judges, making rulings and placing comment on what they see. None of the vested interests placed on here.

When this happened, the judgement is damning of one side in all of this. Yet here we are; one comment written by someone, about someone, without ant knowledge of context - and it's like the JR never happened..... :facepalm:

I’d like to set the record straight on serious allegations made about the council (and my actions in particular) and the decisions we have made over the future of the Ricoh Arena.

When the council decided in January 2013 to refinance ACL’s loan (before I became Leader), we did so on the back of a business plan which showed that ACL could survive without the football club. This was scrutinised at the recent judicial review hearing, which found in the council’s favour.

We always knew ACL would be far more viable with a long term tenant for the sports part of its business. Indeed, within days of the loan being refinanced the ACL Board initiated negotiations to secure the return of Coventry City Football Club. Sadly, these came to nothing.

It is no surprise that the complex legal battle instigated by the football club’s owners and involving ACL, the council and the Higgs Charity has put pressure on its trading performance – and in 2013/14 resulted in a loss. But ACL still has a positive net profit to date and positive shareholder funds.

It is true that Joy Seppala said Sisu needed a freehold or clean restriction-free long lease.

The reality of a restriction-free long lease means that ACL, who still held a valid 40-year lease, would have had to disappear from the scene.

This was simply not possible – ACL had a series of contracts, employees and a loan to the council which needed to be protected, and 50 per cent was owned by the Higgs Charity.

They would not and could not agree to ACL being collapsed to allow Sisu to buy a “restriction-free long lease.” Equally, it was not clear how such a proposal would deal with the loan.

The way to unlock things at the Ricoh Arena was for a third party to buy ACL from the council and the Higgs Charity at market value, recognising that the loan needs to be repaid in full. This was open to Sisu, but at no point did they make the council any offer for our shares.

I could not have been clearer that my door was always open to anyone with a viable business plan, including Sisu. But it was Wasps who negotiated a deal and who believe ACL can be a profitable and successful business – and the early signs under their ownership could not be better.

The council has achieved a commercial price for its shares in ACL, and protected the loan it made. ACL is now in a position to reach its full potential including being a regeneration asset for the city, creating jobs and prosperity. The council’s actions have been publicly challenged in a judicial review and successfully defended.

Wasps, CCFC and Coventry Rugby Club all have a part to play in a successful future for our great city. I’m disappointed that legal action bought by Sisu continues, and means we have been advised we cannot comment further.
