You don't have to go into a court room to clear your name. By dropping the JR it would be an omission by sisu that they no longer think the council did wrong.

The Council could still be found guilty in that situation, but its difficult to see what form of punishment could be applied other than instructing the council to pay legal costs.

You can be 100% right and still lose. You must have a lot of faith in the British justice system to think that all verdicts are always right. I would prefer to avoid the court room if it was me even if I knew I had been wrongly accused.
