So All down to the JR then.....

I am not completely convinced this will get to court. What will happen when the press starts to print some of the delicate mails and reports that went into the public domain yesterday? I would at least hope that would raise some debate outside the message boards.

New owners of CCFC required ?

    1) They can't because CCC won't allow it 2) Playing at sixfields because CCC wouldn't do the deal they initially participated to construct. 3) Debt is owned to themselves. If it's ok for ACL/CCC why not for Otium/ARVO? 4) Ah - the management fees that was never there, but keeps being quoted 5)...

    Higgs v SISU Court Document

I think you will find that sisu accepted a greater business discipline was necessary BECAUSE of Ranson and Dulieu.

New owners of CCFC required ?

Have you even considered that sisu stuck to the plan they agreed with CCC and Higgs? That it may be an outside influence that made the reps from CCC run away from the plan? Knowing what you know now - wouldn't it have been best for all parties if they had all stuck to the plan?

    Higgs v SISU Court Document

I have no answer to why they wanted to pay over 10 years. You suggest it could be because of the cash available for the whole deal - it may be the reason, I don't know. But that is not what capsized the whole plan, so to me this is a minor detail that turns the attention away from the real...

    Higgs v SISU Court Document

They did NOT try to get the shares for £2m - in the sense it was not sisu going to Higgs offering £2m, it was Higgs coming to sisu and ask what they would pay in a deal outside the original plan. There really is a difference! And for it's worth - The plan was capsized by the reps from the...

    Higgs v SISU Court Document

They two figures of £5.5m and £2m are from two completely different situations. The first is part of bigger plan with more elements that would increase the value of ACL and therefor justify a higher price to be paid for Higgs shares. The second is when Higgs ask for an offer outside the plan and...

    They were offered £5.5m!

    Higgs v SISU Court Document

As I said - the rent strike was agreed by all parties: On 6 March 2012 a meeting took place between Mr Fisher (on behalf of the Club), Ms Deering (on behalf of SCL), Mr West and Ms Commane (on behalf of the Council) and Messrs Harris and Knatchbull-Hugessen (on behalf of AEHC). A note...

    Higgs v SISU Court Document

By SISU action I take it you mean the rent strike. Or the rent holiday - that was jointly agreed (before started) by ACL, CCC and SISU. You could also turn the argument on its head and say the value of ACL was based on an exorbitant rent paid by the club. Had the rent from the start been...

    Higgs v SISU Court Document

It was Higgs who asked sisu for a deal outside the overall plan. They had been offered $5.5m and had accepted that amount within the overall plan. Sisu offered £2m for a deal outside the overall plan as the risks were higher.

    Higgs v SISU Court Document

Anyway - finally read through it. Should be enough for a couple of articles in the CT by Simon. I have said a few times over the past years that I hope I get to read the book. Tonight I have read volume 1.

    Higgs v SISU Court Document

This is also quite interesting: 65. It further emerges from the contemporary documents that further key requirements of the arrangements between the Council and AEHC, and the Bank, were that: (a) ACL would refrain from taking insolvency action against the Club until after ACL’s debt...

    Higgs v SISU Court Document

About the rent strike: On 6 March 2012 a meeting took place between Mr Fisher (on behalf of the Club), Ms Deering (on behalf of SCL), Mr West and Ms Commane (on behalf of the Council) and Messrs Harris and Knatchbull-Hugessen (on behalf of AEHC). A note of the meeting is at...

    Who left ACL / CCC?

From the court document: The case arises out of negotiations that took place from March 2012 onwards between the SISU Group, as owner of the Club, 1 and AEHC and the Council, as joint owners of ACL, the company managing the Club’s then home ground, the...

    Who left ACL / CCC?

I wonder if he is going to be on sisu's witness list for the JR.
