Nobody really trust sisu. One reason is we don't know their investors or where the money comes from. KCIC is the same scenario for the time being. His initiative loses my support if I find his backing include Hoffman, Elliott and/or ACL. Until his backing is public known I cannot support him.

No, he only speaks when it's about the charity. Or he said so last time around.

Kcic front bid to buy club

Everybody wants the club back playing at the Ricoh. I want the club and ACL under the same umbrella - SBS&L. There are others on this board who wants that too. The KCIC offer does not offer that. It has been suggested that ACL have the same problem as the club - the debts exceeds the value of...

Kcic front bid to buy club

This will be contender for the most unpopular post today, but this was my immediate reaction on reading the offer and this thread: 'Hmmm - I wonder if someone has now read the judge's preliminary ruling and set in motion a new plan to confuse the situation and put pressure on FL?'

If you read the actual transcript carefully you will notice that sisu QC rather quickly suggest they will accept a ruling of 'no order as to cost'. It then takes the ACL QC quite some time to accept that. Then the judge says he would have come to the same conclusion.

Simon Gilbert, has there been an FL response?

And they shouldn't. There is no need for the club - or the owners of the club - to own the freehold.

I did say several times they both lost. But let me ask you: If you were sued by me and I lost, would you not say you won?

So what did actually happen when the trial ended and the question for cost came up: MR JUSTICE LEGGATT: You take instructions and I will sit here unless anybody asks me otherwise. (Pause) MR THOMPSON: My instructions are simple, given that there's obviously been a judgment in both...

... and we are full circle. Astute said they HAD to sue, so they did. And they lost. What Higgs achieved was nothing but legal fee's. What sisu achieved was more valuable than the cost of legal representation. They gained access to a lot of emails, notes, reports and sworn witness statements...

Taking out an asset and replacing it with equal value makes the company worth less, yes. I think they would justify it by saying the relieved ACL of a debt of £15,3m (or was it £15.8m???) and replaced it with a debt of £14.4m. So that transaction made the company worth £1m more. Then taking out...

You are saying that Higgs suing sisu would not require court action? I agree it was elevated to high court due to the size of the counterclaim.

Ok, then let's blame their legal advisers. But they still lost ;)

It's not widely known. But I find it interesting that many say nothing new came out at the JR. This was definitely new.

So if I sue you and lose the case - would you not consider it a 'win'? It's true that Higgs didn't have to sue, so you could say they lost to an own goal. It was not the counterclaim that took the case to court. It was the claim from Higgs that brought it to court. And playing the 'local...

Really? I thought I said something like 'we need the parties to agree on the history before we can move on'. Why would I even want us not to move forward?
  19. G

No, it was not a draw. The case was made by Higgs to recover costs for the due diligence that was part of the 'roadmap'. The claim was £29t. Higgs lost that case. The subsequent counterclaim made by sisu would never been put before the judge if not for Higgs suing sisu. Sisu lost the...

What the club and ACL have in common is flawed business plans and failing operations. The club can't afford the rent level and exclusion from match day income streams, and ACL can't afford to reduce the rent or give away match day income. At least that was the case when the rent strike began in...
