    Mean while back in court

So when people were up in arms at the thought of SISU potentially paying Higgs less than the £10m formula price as they were taking money from a charity that would have been put to good use they were talking rubbish?

No I'm saying the exact opposite, the banks are in it for themselves. CCC are saying this loan was made on a commercial basis. Try going to a bank and saying your worried about your business going under because your struggling to meet your financial commitments and ask them to refinance your...

Except that wasn't the situation. It would be like inheriting a house worth £200K and then getting a loan for £500K. On top of that when the bank who are thinking of loaning you the money look at your finances you're already struggling to meet your current commitments.

But if CCC are saying there was no risk to loaning ACL £14m as the value of ACL was greater than £14m (you put it at £50m) then when we get to JR2 they will be trying to prove that the sale price to Wasps was not poor value for the taxpayer. How can both be true? Remember the councils own...

It was the judge who asked how much CCC had invested into ACL so he must think it relevant. If you've invested zero does making a risky loan of £14m make sense?

If they make that arguement they totally play into SISU's hands for JR2.

There will always be a certain amount of inconsistency at this level. After all if the players were consistently good they wouldn't be in L1! The problem is when one or two of our players have a dip in form the whole system seems to fall apart rather than other players picking up the slack.

ACL was 50% owned by CCC and 50% owned by Higgs. However they weren't running it day to day, it had its own management etc. ACL was in debt in the form of the Yorkshire Bank loan. There had been an agreement made that any profit would be used to make overpayments on the loan to get it paid off...

In a word no. Buying the Higgs share would have made no difference to the lease the club had with ACL. We'd still have to pay £1.2m a year and the way ACL was originally setup no dividend could be taken before the loan had been repaid.

I think morally they could have had no doubt they were doing wrong, hence the PR and press gags. Legally I would say is debatable. What the legal action to date has shown us is there is a fine line between what is legal and what isn't in areas such as this - think you can apply the same to the...

This happens all the time. What do you think caused the financial crisis? Loans and mortgages are bought and sold by banks constantly.
