    It's an utterly fatuous argument this 'Higgs didn't win so they shouldn't have brought the case' one. Given it's also made by someone who openly admits he couldn't care less if the Higgs or CCC lose money as long as SISU get the stadium, I'd just ignore it mate. It's what I do. :)
