    Wasps pull out...

I read it as being all four, rather than any combination of the four. "To be State aid, a measure needs to have these features" ... but they don't prefix the last one with "and" or "or", so it IS ambiguous!

    Wasps pull out...

What are the chances that SISU would (should??) "complain" to the Charities Commission about the Higgs Trust selling their half of ACL on the cheap to Wasps when there was potential for a competitive bidding process??

    Wasps pull out...

OSB58 - another great commentary, thanks. With regard to the section on Risk, i think there is significant direct risk to Wasps because they COULD be ordered to pay back what is regarded as the state aid component of the transaction. I think the complaint is made about the transaction rather...

    Wasps pull out...

I was thinking overnight that the snippets of emails and historic data being put out by SISU were around the time the complaint would have been made to the EC. I'm sure it was coincidence!!

    Wasps pull out...

Absolutely, although i suggest the case might be taken a bit more seriously if you are the party (e.g. SISU) that has lost out because of the preferential treatment given to another party (e.g. Wasps) in being handed state aid (e.g by the Cuntsil)

    Wasps pull out...

Well certainly not SISU's, aside from the fact of drawing EC's attention to it.

    Wasps pull out...

I'm still unsure who to believe in all this, especially with the timing of leaks, etc, but it strikes me that the EC investigation has the potential to put Wasps at greater direct risk of financial loss than SISU's attempts at getting a JR against the Council. As i have said before, i have been...

    Wasps pull out...

I have to say that i have been fairly pro-SISU all the way through this. But i am really disappointed that they have felt the need to make the complaint to the EC then seemingly enter into negotiations in good faith, knowing that Wasps would probably not be very happy about it. It would not...

    Wasps pull out...

I don't believe there is. Only if someone else provides incontrovertible evidence questioning the veracity of the complaint.

    The Ricoh..

Not sure there is any evidence of that. Council have nothing to do with it!

    The Ricoh..

From the EC website ... What is State aid? State aid is defined as an advantage in any form whatsoever conferred on a selective basis to undertakings by national public authorities. Therefore, subsidies granted to individuals or general measures open to all enterprises are not covered by this...

    The Ricoh..

According to Giblet's academic expert on the radio this morning, the EC rarely get involved in state aid cases like this that are in the past, and that things are normally brought to them in advance of the aid being given. I'd say they are even less likely to get involved with something 15...

    The Ricoh..

Well they'll start looking into it in the meantime (preliminary evidence gathering, etc), but might not make a decision for quite a while - i only looked at one case, which may have been horrendously complex or something. This might turn out to be open and shut, fuck off and grow up! Cue ECJ...

    The Ricoh..

It MAY be that the EC have only just told the parties that a complaint was received in February
  17. O

    The Ricoh..

But OSB58, is it not the case that SISU (or any of the parties you cite) may have made the complaint to the EC, but it is the EC ONLY who will investigate and deem if any state aid laws have been broken, which might be followed by recovery of such state aid (presumably from Wasps)???? So you...

    The Ricoh..

Don't hold your breath on this one, guys! EC has a searchable database of decisions on State Aid cases. One in the UK was notified to the EC on 21/12/2012. The decision to progress to full investigation was taken on 21/02/2019. So the preliminary investigation mentioned by Giblet's "expert" on...

From ec.europa.eu: "the Commission has the power to recover incompatible State aid." That's why!
