The route in national courts hasn't been exhausted - there is still the potential for civil action against Wasps or the Council (or even Higgs Trust), but that would only have a reasonable prospect of success (in my view) if the EU Commission found that they had acted illegally under EU law...

I'm guessing that they don't want to be in a position where a court finds that they have to pay back £20 million quid (or whatever) back to the public purse because of a case brought by their tenant. I can see their point - it doesn't make for a cordial tenant-landlord relationship, does it?
