    I think Sisu's barrister engaged with the argument (at around p106 of the transcript from Day 1 of that case IIRC), but as you say that's not producing a document.

    Does it matter if it goes back up after 3 years? That's all the time Mr Fisher said he needed for his vision to build a new stadia. Back to the Ricoh for three years at £400,000 then... Bam! Just as the rent goes back up, off to the new home to reap a bountiful harvest of pie income.

    I wasn't in court yesterday and I haven't seen a transcript, so I'm not certain on the context and I'll have to go on what is written here, but didn't Sisu's barrister in Higgs v Sisu tacitly accept Sisu had approached Yorkshire Bank directly before August 2012?

    I don't think the JR is the hurdle, I think Sisu are the roadblock to a realistic deal* and that the JR is only a hurdle Sisu put in the way (in my opinion). *I don't think "unencumbered freehold" is a realistic deal - at least not at the price I suspect Sisu would be prepared to pay.
