I would say death threats or wishing death or violence on specific people falls into that category too, I suppose it depends on how much of a free speech absolutist someone is.

The phrase used is ‘credible’ threats. What that means exactly is open to debate which is why it can be argued the rules aren’t enforced with uniformity.

In politics, perceptions often matter more than the reality.

Who was the tweet aimed at? No one specifically. It was an unfunny joke. Using your own logic, anyone who says 'punch a fascist in the face' would also constitute incitement. This, of course, would be ridiculous and a curtailment of free speech.

The man hasn't been charged with an offence (yet) so as of right now, there is no crime to answer for. What I would say, you may champion this example but the law its current form could be flipped and used against you. For example, should the police arrest the hundreds of people tweeting violent threats to JK Rowling (or anyone)?

Again, you're mistaking your opinion for the law. Incitement to violence is against the law. Whether you think the law is correct or not is academic, the police have a duty to enforce it. If I called for someone to be assaulted, and it was a credible threat, then I couldn't complain if I was arrested. That's the law, it's very simple.

The tweet was aimed specifically at trans women. Specifically. Read it again. And then read his history on this issue. He is rabidly and persistently and publicly anti-trans. Then consider his lack of apology for it. So "unfunny joke", I don't think so, that's just a coward's way of trying to weasel out of it, imho, but the court can decide. It met the standard for arrest.

If you don't want to be arrested, don't advocate for violence would seen to be the sensible approach. Does that restrict your free speech in any way?

And this "oh they're appealing so they're not guilty" is a wilful misunderstanding. Connolly was found guilty. She called for the burning of hotels where there were immigrants, and admitted to being a racist. She did it at a time of very serious disorder, which I suspect was an aggravating factor.

She appealed, and lost her appeal. You might think the sentence was harsh, I'm not sure I'd agree, she quite literally called for a large number of people to be burnt to death when a significant number of people were clearly intent on trying to do exactly that.

Either way, same story, don't want to go to jail, don't tweet racist calls to kill people in the middle of racist rioting. It's hardly unreasonable.

Why she's become a hero to some people says more about them than perhaps you realise.

The law has proscribed a Palestine Action a terrorist organisation. As @fernandopartridge has pointed out, arrests have spiked. As it’s the law, clearly they’re all terrorists who deserved to be arrested and/or charged, right?

With free speech, you apply the principle to all or you don’t actually have free speech.

‘Don’t want to go to jail, don’t tweet racism’ is a chilling Orwellian notion. You’ve confirmed the obvious, you don’t actually believe in free speech.

I can only think of two places I've ever worked that didn't have mixed bathrooms, was never an issue.

Similarly I recall when I was living in Portsmouth and they opened a new swimming pool the changing rooms were mixed, again it was a non-issue.

As with leaving the EU it seems to have become and issue when people have been fed a stream of targeted social media campaigns.

Personally I think the people you want to keep out of changing rooms of any type are sex offenders, child molesters etc.

Worth pointing out that the people such as those protesting at the weekend were protesting against the proscription and want PA removed from the list. So essentially they are protesting for a change in the law not saying the law shouldn't apply. Although the authorities have also repeatedly been told that they are arresting people who are highly unlikely to meet the threshold to be charged and even less likely to meet the threshold to be convicted which raises the issue of why so many people are being rounded up with the knowledge they won't be charged.

But overall that's different to saying it is wrong to enforce the law and sentence someone, who has pled guilty, in line with sentencing guidelines.

If you want to argue for a law or sentencing guidelines change then thats fine but the suggestion from some people that it shouldn't apply to some people is absurd.

Read it again. Try harder. All you've confirmed is that you're struggling with comprehension. Show exactly where I've said that the law shouldn't be applied equally.

Try actually quoting something rather than just ranting, and it's a debate worth having. At the moment you're just being lazy. Waah hates free speech, that's just you whining, not what I said.

There's nothing chilling about saying that people are not allowed to incite violence, unless you advocate for inviting violence. Is that your position on it. Connolly is your hero now?

It’s obvious that I’m arguing against the laws themselves.

It’s apparent that Duffer is happy for people to tweet ‘punch a fascist’ but not ‘punch a trans woman in the balls’. If you want to criminalise all violent speech, go ahead and do that. If you want to apply said rules only to people you disagree with, is just fundamentally wrong.
