That might be a good result for SISU. If it moves out of the hands of CCC there could be an increased chance of an offer to make it all go away.

Agreed. If the government are involved then the emotion will be removed from one side and hopefully someone will bring sense to this dispute to end this ongoing legal saga that benefits nobody (... at the moment).

In theory things should have become clearer.......

bang goes that theory...... I think I feel more confused by that than anything

the summaries provided pointed to so many contractions, and dare I say it inaccuracies. one minute things over valued the next under valued :thinking about:

I have no real idea which way this will go. I would think most of the things said were not relevant and the judges will strictly interpret the law in a very narrow way

One very interesting thing was that it appears CCC were talking to Wasps, or about Wasps, before they were taken over. This ties in with CRFC saying they were approached about working with Wasps by Richardson before he took them over.

Kind of blows the notion that they were planning to move back to London but couldn't out of the water.

You would have thought when the Lords got the heads up about this case, they should have asked straight away where is the QC for the government.
I would imagine if they are to be held accountable if the decision is in SISU's favour that they may ask for another hearing
As the Lord asked why there were not represented in one of his first questions but then just cracked on! Surely if the Government are liable he should have adjourned it to firstly to check if it would be them who liable and secondly to inform them do they can represent themselves.

It all comes down solely to the loan and whether it was state aid or not. In that respect a lot of the details put forward are irrelevant.

However I would say that the talks relative to ACL value are relevant, as the lower the value of ACL the bigger the risk can be associated with the loan. The bigger the risk, then the bigger the interest rate that should be applied.

That risk would have been at the time of the loan but could relate to potential future incomes known to CCC at the time like any Wasps interests.

Judges, not Lords. We have not had the case raised to the House of Lords ... yet!

It's a shame none of the press are interested in the council telling lies on the radio or at all, if it was CCFC there would be FOIs going in left right and centre and referring back to it at every chance.

The fact she said the first contact was July the year they took over, but they were waiting wings with a document from 2012 is one.

Imagine if it was something proving tim Fisher wrong about a stadium....which is also common.

If he had said there was 5% chance there was going to be a stadium in Solihull, there would be fois, minutes from council meetings to try and disprove him.

Whereas ann Lucas and maton seem to get free reign on bullshit.

Why would you need FOIs ? You've got three judges who are going to tell you all you need to know.

Aren't they just judging if it was state aid, rather than the council lying to tax payers? It seems they are untouchable with things like that.

The same as the "washing its face". Soon turned into "misadvised" and left at that.

Thankfully Tim Fisher doesn't run a city.

Again regardless of what happens here it's the fans who are put through it and lose out.

You have to admit it's all a much to do about nothing. It's boring and it seems all rather irrelevant. It's got nothing to do with football and everyone is trying to argue over every fart made. It's boring and tedious.

I guess the saying is true.... "The only people who win are the lawyers"

Nick you'd never unravel a he said she said debate. What any organisation public sector or private says to the public compared to what is really going on is miles apart.

Well. Sounded like more he said she said to me. I was sort of expecting the judges summing up from the JR to be picked apart in detail through the appeal but that just never seemed to happen except a very few times. Sounded more like a recap of the original court action than dissecting the conclusion from that. Based on that impression I can't see the appeal succeeding but then again thought they'd won originally so what do I know. SISU's legal team have probably swung it this time and if that does happen I wouldn't be surprised if the most surprised people are SISU's legal team. They'll probably be kicking themselves because the gravy train has just reached the end of the line unless they can find an angle to appeal the compensation claim because there aren't enough zeros on the cheque

One thing we do know is that if SISU lose, they will appeal to some other court.
