One thing that has come out so far is that more than half of ACL's value derives from CCFC. Yet CCFC benefit from none of it, ludicrous state of affairs. Not saying it should be handed over for nothing either!

I don't think the Yorkshire Bank wanted them to settle there debts with them as they are more interested in keeping the mortgage going. The longer they have the mortgage is with them the more they benefit financially. The fact that the Yorkshire Bank was trying to put them off in doing this is an example how these capitalist banks work.

Why else do home owners with a mortgage have to pay for a get out clause if they want to pay off there mortgage early. Because the banks lose out.

(Slightly weird seeing Clive Eakin covering a very tedious court case when he would be commentating on the final day of Warks v Lancs up the road. (Warks just got another wicket. Lancs 67 ahead with 7 wickets remaining. Could be good for a finish today?)

Again, I can't understand this. In what way is the landlord's negotiations with it's fund provider in any way linked with the landlord's negotiation with it's tenant? I simply cannot understand on what basis this is drawn.

Have to say, I've heard nothing in the case so far to give me any reason to change my mind from the view that this can only be sorted out around the negotiating table rather than in the court room.

I think it's been martcov who has talked a lot about dropping the JR and I think that getting it out of the way (even if there are appeals) will be a step forward to getting some progress.

Of course they have. All of the talk was of some 'secret deal' hatched between SISU and ACL with a view to disadvantaging the bank with a view to SISU then stepping in and enjoying a cut-price bonanza. This really would have been the 'smoking gun' often discussed on here. But those allegations don't seem to be true in the slightest. Or at least haven't seen the light of day as yet. And to be frank, if they had a slither of truth to them, they'd be out by now, surely?

I think its brazil vs Croatia tomorrow straight after opening ceromany. I have verbally betted that Croatia will be the worst divers in the compo.

Its quite difficult to get excited about this world cup for some reason

Even if it did happen wouldn't that amount to fraud and put Sisu in as much trouble as Acl ?

That isn't the smoking gun is it? Never was my opinion. The fact an almost equivalent offer from YB was on the table before CCC bought out the loan is bigger news.

Which is why they have chosen national court as venue. Unlike the EU court of Justice the national court can rule on damages and compensations.

Did YB know about Sisu's intention to liquidate?

If you're looking at the decision made at the time, wouldn't it be reasonable to suggest that the council were planning for the worst case scenario of no CCFC and YB weren't?

(genuine question, I've not been following what YB were privy to)

I expect the judge to be just as harsh to CCC when appropriate, don't read anything into that.

Gilbert's Tweet this morning: Had a peek at Sisu's skeleton argument. Main thrust is terms of council/ACL loan were "wholly uncommercial" contrary to EU state aid law

How can it be uncommercial, if YB made an 'almost equivalent' offer?
