Deadline for SISU to confirm appeal to Court of Appeal? (1 Viewer)

Does anyone know when this is? Somebody said it was tomorrow, but I don't know if that's confirmed....

I think the confusion is to when the verdict was given down and therefore when the 3 week timer starts. IIRC it's tomorrow if the timer starts from the date on the judgement, or next week if it's when the judgement was made public.

It's tomorrow.

Reckon they'll appeal? TF has indicated they will but not so much recently - I expect they may well do, but it seems a pretty folorn hope when other signs about renewed negotiations with ACL seem more positive.

If this is fruitless but prevents an agreement, I can see SISU pulling back. That said, they might conclude that, whatever ACL say publicly, they would negotiate anyway and therefore continue with legal action to keep a lever in place to use against ACL.

So, and I say this quietly, am I right in saying if all goes to plan, by the weekend Sisu could be fully paid up to ACL and there be no ongoing legal action? Thus the prerequisites for talks will have been met? (Though of course, this only puts us back to where we were at the start of 2013)

Yes, but don't hold your breath

If they do appeal tomorrow will we find out straight away or could it be days / weeks before we know about it?

So Tim, are you appealing again or not?

I think the time limit for lodging an appeal to the Court of Appeal runs out tomorrow doesn't it?

Despite your recent promise to keep the fans informed, you've not mentioned whether you want your "hopeless" case to be heard by "3 Senior Judges".

As you know, but have chosen to ignore it seems, an imminent return to the Ricoh hinges upon whether you intend to continue to pursue the JR or not.

So Tim, could you please inform the fans what you have decided to do and why?

Think fans would be a distant 4th in line to know at best. Deadlines exist for a reason. Two ways of looking at it. They said initially they would appeal. So if you take them at their word...more fool you...assume they will. If you choose not to take them at their word...assume they will accept the original decision until an official announcement that an appeal has been received.

Surely this money should have been paid already? The funds were in an escrow account pending the outcome of the Football League's decision?

I agree with that. If it's been in an escrow account, and therefore not providing significant benefit to SISU; it should have been paid last week. If they're holding on until the last moment, that really is petty beyond words.

If last night told us anything, whatever your persuasion in this farce, it's that these two parties need to be in negotiations. Our club is being strangled. Pay the cash, drop the farce of a case; and get our club back where it always should have been.

100% Agree with you MMM on this occasion.

I still don't agree with your use of the word "Inherit"

i think that there has been no news because they arent appealing. The DEADLINE to appeal is tomorrow so by that you would have thought that SISU would be finilising the appeal ready to send either late tonight or tomorrow morning. With this in mind i dont think they are appealing- i think that after weighing everything up the costs and probability of failure is too high, especially considering that the stakes are playing at the ricoh. Theres too many rumours for them all to be coincedental, theres no smoke without fire so they say. They cant come out and say negotiations are taking place because they wont want the backlash just in case something goes wrong. I imagine we will go without any news tomorrrow and a return to the ricoh will be announced in due course. My personal opinion is that they will come out and say that the first game back will either be Yeovil on the 13th of September or PNE on the 27th. That will give enough time for excitement to creep back in and hopefully get a bumper crowd against one of the better teams

Even if they don't appeal, who knows they may try some other avenue for litigation, don't rule it out!

For those asking, deadline for Sisu to appeal judgment in JR is today. As soon as we know if appeal is/isn't happening we will let you know.

I presume there won't be an official announcement either way, this will just get quietly filed (or not) by the lawyers and someone will have to pursue the club / legal system to find out...

I think we've been well past the final day for appealing when we've found out in the past.

I would think if you were SISU and you weren't putting an appeal in you'd get a press release out ASAP saying that following the payment yesterday and passing of the deadline there is no longer a barrier to talks and they want to speak to ACL ASAP. Doing that would put the ball back in ACLs court to keep their word and attend talks.
