CCFC are nothing to do with the argument at this point - the offer wasn't available to anyone else and thus they clearly didn't price correctly due to the immediate increase in value right after the deal.

It's about whether or not the council sold an asset undervalue to the detriment of council tax payers...

He adds that this doesn’t mean the claimants have no merit in their claim

QC claims delay is enough to throw out application
Mr Goudie says his argument of excessive delay is particularly important because there are third parties with significant interests in this case.

The judge says “there is a public interest in not having thing overturned many years after the event”.

Mr Goudie says this is one of many “knockout points” and that there was “delay after delay” in bringing this case to court.

He adds the court should take into account any “lack of urgency” from the claimant.

He’s referring to previous case law to back up his points about why the case should be thrown out.

Mr Goudie says the legal principle around delay not being allowed would be “seriously emasculated” if the court did not agree with him.

He says Wasps and Ricoh firm ACL are the main victims of the delay.

He says the delay issue is all that needs to be addressed. He adds that this doesn’t mean the claimants have no merit in their claim, but he feels it’s unnecessary to go into that because the delay issue is the only one that needs to be addressed and is enough to have the application thrown out.

I wonder if they would prefer to wrap this up based upon a technical error which is harder to dispute than a subjective debate based on differing valuations? Seems to be labouring the point though...

The qc wants to get this thrown out on time alone, one of many points he could state but is obviously going for the most simple and clearest reason in his eyes. Is he right to do this?? The judge will soon tell us...

What outcome will folk realistically be hoping for from today? I really don't know win or lose what it means for Cov... I can't make my mind up which would help SISU move on quicker... I suppose I'd prefer the council not to get dumped with a huge bill, but in terms of looking at the best outcome for Cov I don't know where this leads?

And I remember those who said nobody would be interested in the Ricoh. SISU thought exactly the same.

Hopefully they'll get their win and walk away from us happy and if the council were dumped with a bill for it then maybe they'd start chasing up some of the £millions arrears of council tax that they're owed. Sadly i doubt it on both counts though.

Why are they even in court if it is too late though? Surely if they have a cut off date they don't all go there today and it's rejected straight off.

I just want an outcome where the legal process comes to an end. But I can't see it happening whatever happens here. If SISU don't get the right to JR2 they will appeal. If they lose JR2 they will appeal. If CCC lose JR2 they will appeal.

All shit really.

They are in court to see if they can do it for real. They could get this hearing whatever.

I would have expected that, but I am pretty ignorant of the whole process... Could this be surrounding the changes possibly? Is the claim that SISU lodged a vague JR then built a case over 2-3 years?

If this judge throws the sisu claim out I can't see where else sisu can go on JR2, wether that brings about the end of sisu here not sure Sepalla will play hard ball initially but I suspect Hoffman and friends will rekindle their interest soon

They will appeal with Fisher most probably saying that the judge doesn't know the law or what he is doing.

We will be back in court no matter the outcome. Sisu lose they appeal, they win the right to appeal then it will again be a long drawn out affair.

More court, more case's, more off field issues that will again keep us on this continuous wheel of BS. Shame but reality is no matter result today Sisu will not give up or go away.

The way I'm reading it is that it's too late to make the amendment. If JR2 is to go ahead it has to be on the grounds of the original applicant.

it's not a "statute of limitations" argument just that if SISU were serious should have started proceedings/appeals etc. at each earliest possible opportunity rather than waiting until last possible moment on several occasions.
other argument is that the proceedings continuing to hang over parties of interest (i.e. Wasps/ACL) hampers their business etc.

Again it doesn't matter. They didn't give anyone the opportunity to bid on those same terms for a publicly owned asset. Claims that Sisu would not have bid on those terms are clearly incorrect as they attempted to purchase the Higgs share at the last minute.

Don't get me wrong, if Sisu win this case they don't win the Ricoh back - the damage is already done, but it is clear, at least from my perspective that CCC made sure that they were shafted (with proof to back this up - "hell freezes over" etc).
