ACL Finance Director John Street Conflict of Interest? (3 Viewers)

I don't know about anybody else, but has the issue of this guy now being the Finance Director of ACL after formerly being in the same position at the Football Club been discussed? Particularly considering he will be involved in any negotiations around the rental payment. I am not throwing accusations here, just pointing out the complications of the financial management of ACL, Higgs, City Council and CCFC.

Below is from his own Accountancy body (CIMA) and below that his bio from ACL.

"A professional accountant in public practice shall take reasonable steps to identify circumstances that could pose a conflict of interest. Such circumstances may create threats to compliance with the fundamental principles. For example, a threat to objectivity may be created when a professional accountant in public practice competes directly with a client or has a joint venture or similar arrangement with a major competitor of a client. A threat to objectivity or confidentiality may also be created when a professional accountant in public practice performs services for clients whose interests are in conflict or the clients are in dispute with each other in relation to the matter or transaction in question."

Skills and experience: Before joining as Finance Director and Company Secretary in 2011, John previously worked for Coventry City Football Club for 14 years. He joined in 1997 as Management Accountant and oversaw the move in 2005 from Highfield Road to the Ricoh Arena before he became Finance and Operations Director. He had responsibility for all financial and operational matters at the stadium, training ground and academy.

He has a broad experience of not only financial matters but also in the day to day running of a football Club. Between 2009 and 2011 he also held the post of part-time Finance Director for Arena Coventry Limited.

John is a chartered member of the Chartered Institute of Management Accountants and has a B.Sc. (Hons) degree in Accounting and Financial Management.

But he is not in public practice, he started at CCFC then was "shared" by CCFC with ACL and is now with ACL. That's what you have posted. No conflict of interest exists. The Club wouldn't have shared him if they thought there was a problem.

Whilst I agree that he is not strictly in public practice, ACL being purely the 'vehicle' to avoid the City Council and the Charity being involved in a commercial enterprise (which they can't do). However, for all intents and purposes ACL are acting on behalf of and are significantly influenced by the two. Because of this and for transparency purposes it is hard to argue that a potential conflict does not exist?

Your quote from the rules for accountants relates to accountants in public practice. He is not in public practice so the rule does not apply. He is also allowed to handle a football and kick a tennis ball as he is working as an accountant in a private company and not playing football or tennis. There are lots of other things he is allowed to do where there are rules that prevent other people doing them.
