Yes it is the same logic. It was widely reported at the time that unless CCFC could sell Higgs their share the club would have gone into admin. Now as McGuinity and Robinson were "the only show in town" at the time, is it not likely that CCFC would have been liquidated?

How could a mediator force either Sisu to buy or the council to sell? Someone could negotiate a deal, but unless sisu are serious about buying for a fair price, and the council and higgs selling, then it would be pointless.

Because ccfc willingly signed a contract that allowed acl to build there business plan around it? Should Debenhams pay nothing in rent to West Orchards as they are the main tenant?

My opinion is the stadium value was much lower then and Sisu want this information for their own advantage in the JR. The value of the stadium in 2012 has nothing to do with the current value of the stadium, therefore it will have no bearing on what to bid in 2014.
