Wasn't there something related to the JR where they tried to gain access to CCC and / or Higgs information and the judge refused the request?

I think people are forgetting that it was Higgs that took this to court in the first place not SISU so it's not like its part of some grand master plan to get information.

Are you certain? I thought you had the options of admit liability, defend the claim or issue a counter claim.

Both I would assume as you would rule one way or the other.

So it seems the clause Higgs are claiming under does exist and has a limit (I guess the £29K). Unless there's exemptions written into the clause SISU will be stuffed won't they?

Both sides have had to lay out the basis of their arguement over the last few hours. If you had something that was going to blow the whole case out of the water you'd mention it as early as possible so you could get it all over and done with.

That would be the worst possible for scenario and in my opinion the best result for a quick return to the Ricoh. If the judge turns round and basically tells them to get stuffed and stop wasting everyones time they might think twice about how the JR will go.

CT asked both universities in March and both said they hadn't had talks with SISU. Of course they could by lying but if there were talks going on wouldn't a no comment be a better response than an outright lie?

Sure the judge will want to check that. I can see how you could rack up £29K in legal fees etc on this sort of thing but a breakdown of the £290K could be interesting reading. What odds on a large chunk of it being one part of SISU charging another part or payment for Fishers time?

Of course but from what is known at the moment, and of course more will come out in court, a HOT was agreed and then nobody heard from SISU to complete. SISU have said this is because another deal went on behind their back but if that didn't happen until after SISU had walked away I would think...
