There are draws. We used to do replays so that one team could win. Now we don't have the patience for that so we do tie breaks. We could just flip a coin but the drama of penalty shoot outs is box office. The game which preceded the penalties was and will always be ... a draw.

Quite right. We didn't lose the game, we lost the tie. It was decided by a tie breaker. Penalty shoot outs are merely tie breakers in cup competitions. This isn't hard or pedantry it is just a fact.
