So you think a charity should have just written off money owed to them?

What about cashflow, if they have to divert funds to pay legal fees knowing they won't get them reimburssed until months down the line when they go to court and get awarded costs it could lead to issues. None of us know if it will impact on the Higgs regular activites and neither do SISU but...

Disheartening Sky Blue's Story On The Way..

How could ACL refinancing with CCC possibly impact on SISU purchasing Higgs 50% share of ACL on which we are told a HOT had already been agreed. Even if it happened over the period the sale was being discussed ACL owed Yorkshire Bank the same amount (at a higher interest rate) prior to CCC...

No one has said they fear it but while this case is pending they will be paying out legal costs and wasting time when they could be getting on with doing good in the community.

    Explain to me

That never happens though does it, not just in SISUs case but generally? It will get to court unless Higgs agree some settlement, in all likelihood the jugde will go 'this is a waste of time', have a dig at SISU's lawyer and award Higgs costs. This seems far fetched even for SISU and what they...

    Explain to me

It's a common tactic for a bigger organisation against a smaller organisation. The hope of the bigger organisation, in this case SISU, is that the smaller organisation, in this case Higgs, either get scared off or run out of money to pay lawyers and therefore agree to drop the initial action...

    Explain to me

This was stated several months ago by Joy to the council allegedly. I seem to recall Labovich going mental about it and being outraged that anyone could think SISU would behave like that.

Charities have a legal obligation to pursue money owed to them I believe. To be honest even if SISU hadn't agreed to it before hand they should have just put their hand in their pocket and given Higgs the £30K that they left them out of pocket. The rate SISU are burning through money it would...

    Blanket ban on Northampton

This is a great idea, get some of the guys up on the hill out with buckets and do a collection for Higgs. Whatever you think of the mess we're in Higgs do a lot of good work in the city so people can't really object to having a collection for them.

    Explain to me

Same idea as when we sold HR to pay for the Ricoh! Ignoring things like they may sell Ryton then bugger off with the money having not built the replacement the general idea is they want Rugby council to change the status of the land so houses can be built on it. This makes it more valuable and...

    Explain to me

For a while now we have known Higgs are suing SISU. This is for the legal costs incurred by Higgs when dealing with SISU's attempt to buy the Higgs share of ACL. This was, we are told, what was agreed with SISU, that they would cover all costs. SISU walked away from that deal and have since not...

Or an even better standard practice is to actually pay your bills.

I've always been in the 'would go back to the Ricoh even if SISU were in charge', this report breaking today is the first time I've thought about changing that stance.

Disheartening Sky Blue's Story On The Way..

How legal is what SISU did? If they go to court and state that they were deliberatly distressing ACL to try and purchase the mortgage from Yorkshire Bank on the cheap are they on a sound legal footing? Obvioulsy it's not right from a moral standpoint but can you legally distress a business by...

At least we know now why Ann Lucas thinks Higgs won't sell to SISU. Would you in their position?

Sisu - just fk off will you, utter reptiles

So what if they did? ACL have always had a loan to cover the lease, first with Yorkshire Bank then with CCC. If SISU wanted that loan to no longer exist upon them taking ownership of a share in ACL they would need to pay it off. Does it make any difference if they pay off Yorkshire Bank or CCC?
  19. chiefdave

Disheartening Sky Blue's Story On The Way..

Absolutely disgusting from SISU. Unless PWKH is outright lying Higgs agreed to sell to SISU and never heard anything back from them. Not sure what the loan has to do with it. From day one ACL has had a loan they've been repaying, first to Yorkshire Bank and then to CCC. If SISU were concerned...

So what will be the outcome?

This is where the JR plan falls apart. First SISU need to win it, think they're going to have a very difficult case to prove. Then the court needs to rule that ACL have to pay back the loan, even if the court finds in favour of SISU it's far from a forgone conclusion the loan will have to be...
