How is it a theory? The court case is over the amount Wasps paid, there exists an independent valuation for that. Surely if that valuation shows the price you paid was in line with the valuation you put that in front of the judge and its case closed. If those that had the valuation carried...

But on the open market what has greater value, ACL with a 38 lease or ACL with a 250 year lease?

That's my thinking. If the valuation backed up the sale price they would get it in front of the judge ASAP. Once you've got an independent valuation giving a price at or lower than the sale price SISUs case collapses. Which then makes you wonder why they don't want to provide that valuation...

The fact that Wasps purchased ACL and that some of the valuations we know of, particularly those used by Wasps for the bond are just for the lease is understood by pretty much everyone isn't it? Its just shorthand that people don't explicitly state it every time they are talking about...

Theres at least one valuation from prior to the sale that Wasps have refused to provide. You'd think one of the first things that would be asked for by the judge is to have all the valuations that were done prior to or after the transaction to be made available to them so they can see exactly...

The whole reason this is back in court is because the judge that put this through to appeal said they were linked but the previous judge had viewed them as separate.

This is the biggest thing for me. The council have a duty to the taxpayer and at the end of the day, no matter what ruling is made, they haven't carried out that duty. Would there have been others interested leading to a greater sale price? We'll never know but it certainly wouldn't have made it...

Can you provide a link as google isn't showing any such formula for commercial properties. Are you referring to the Leasehold Reform Act which gives the tenants of houses, in certain situations, the right to a 50 year extension?

It will be for housing. It has been applied in the past to offices that were formally houses but I don't think there's any examples of it applying to football stadiums. There is a right to extension on a commercial lease but its common practice to exclude it in the lease. Hence you see so may...

Even the council wouldn't be stupid enough to lease a stadium out without excluding the right to renewal. How have you worked out Wasps have paid top amount? The lease extension works out to £5K a year.

As far as I know there was no reason, it was just the way it was decided between Wasps, CCC and Higgs. There was zero chance Wasps purchased the council share not knowing if they would be able to purchase the Higgs share. Equally there was zero chance Higgs would accept our bid for their 50%.
