Judicial review day 3 - judgement day

That's the biggest worry if that's what they are gearing themselves for then we have another few years of SISU building towards a civil action with no stadium built. The biggest threat to them is expulsion from the league after three years. If it gets to that point them they can still negotiate...

Yes she has the same opinion as you. That there were things the QC picked the council up on. Despite the council QC seeming more confident he was not as good when challenged.

Thanks Rob Also do you how SISU have now moved the goalposts for their case? Is it that they are now saying that councillors were not given enough info?

Judicial review day 3 - judgement day

There is likely to be no remedy if SISU win IMO. SISU illegally withheld rent. Thus their behaviour unreasonably led CCC to make a potentially incorrect decision. If the Judge feels SISU's behaviour contributed to the council making the decision he can say no to a remedy.

How could it not be illegal. It was a legally binding contract they broke? We're they rely suggesting that wasn't illegal?

Completely independent and nothing to do with the club. She is probably just updating him about what we fans want for the new stadium.

Apart from the fact it was already done ages ago as Grendel well knows. I take it you or Rob were not in the site a year and a half ago or missed it?

    who's winning then??

SISU gave evidence first for a day and a half. Council gave evidence for half a day and will do a little bit in the morning. The judge pulled SISU in line a few times and did not need to when the council gave evidence. However that happened during the Higgs verses SISU case. It actually did...

Judicial review thread - day 2

OSB met PWKH. OSB asked questions at one of the meetings. He was open and honest about who he is and what his association with PWKH was. Can't be bothered to dig it all up. However it all came out on here and there was nothing sinister. Not sure where Rob was when this happened

I think you would get a seat for life. I am still unsure as to whether you are a council plant. Every post from you ends up in 15 posts defending the council and they end up coming out with a shining halo. Just like RFC is a Ricoh Arena Plant ;)

Place Your bets - who will win the JR

SISU with no remedy applied as the judge will slam SISU, saying their actions caused the decision to be made. Everything will stay as it is.
  16. D

    Are you shocked?

Apologies if I have missed something however, I am pretty sure that we were due to hear things in the last court case and the JR that was going to shock us and change our views. Now I think this revolves around the allegation that the council were conspiring to to get SISU out and get new...

The same happened in the other case with the judge continuously dragging SISU back in line only to call it a draw.

    Higgs shares and income streams

What about the rent deal, did that not provide access to 80% of income streams?

    Judicial Review thread

Also again if this correct SISU's action created the situation and leads to no remedies. Making the JR a pointless exercise. Wish they would make a public offer for ACL or Long Term Rent

    Judicial Review thread

Can't see it when you look at how a judge decides whether to apply a remedy or not. If he thinks SISU's behaviour contributed in anyway or form he can use his discretion to not apply any remedy. With his comments today that ACL was a going concern till SISU withheld the rent I can't see how he...
