    Just because the Judge appears to be being harsh to the SISU QC, I wouldn't take bets on the outcome of the case yet. It's just as likely he'll tear apart any flaws he sees in the Council QC's argument. I sense it's just what Judges like to do. ;)

    Quite. If the rent's paid, or even a lower rent agreed (as was, supposedly, being negotiated), then there's simply no way to replace SISU as owners unless they chose to sell. You can't force someone into selling the club, even via admin, unless they refuse to pay their bills.

    We've been here before. Many, many times. Even SISU seem to accept that the level of the rent was related to the amount of the mortgage. Hence the plan to buy out the mortgage, rather than just lobby for a rent decrease. Either way, it's old news, surely.

    I think what the judge means is that it can't really be classed as paying the rent. This also points back to a decision in court as I recall, where SISU were told they had to top up the escrow as well as paying the rent due.
