    Valuations of ACL

Am querying couple of things NW. The fall in value with and without CCFC seems too much when you factor in the risk of having a football club that is a financial disaster as a tenant. Is the Football club tenancy really worth 13.2m to ACL when (as was known) the possibility of non payment was...

    Valuations of ACL

You see the question I have on that is ....... surely CCFC were a high risk tenant, cash strapped, stopped paying rent, wanting rent decrease, deteriorating relationship etc etc ...... could it be argued that far from mitigating the risk CCFC posed both a potential for income but also an...

Getting us back to the Ricoh remains simple

Was it clear that the rent reverted to 1.3m or was it if no further negotiations were done in the 3 years that it would? It read to me like it could be renegotiated so it might actually never revert to 1.3m What that 3 years does do is allow time to build a working relationship and trust. If a...

    Valuations of ACL

We learnt at the JR that the valuations of ACL were 19.6m with CCFC there at a rental of 1.2m and 6.4m with no rent from CCFC. That's a gap of 13.2m Often the value of a rental tenant is expressed as a multiple of the rent paid. It would seem in this case it is a multiple of 11. What...

    The spin continues

First off SISU need to state clearly and publically what it is they want the Ricoh or a new stadium...... and then JS, TF, ML, etc to ALL stick to it. If it is the Ricoh Arena they need to be very clear as to what basis of return they have in mind and what is definitely out. If it is to be...

    FA and the escrow account?

I think the Club were due money from the FA football foundation to help with the Ricoh project. Because of the state of the clubs finances it was agreed there would be a rental deposit that would be held in the Escrow. This account would show as restricted funds on the CCFC annual accounts and...

Judicial review day 3 - judgement day

You would think so NW, and I agree with you I think the forum is pretty pointless too. However I accept that some see it as a step to transparency by all sides - I just feel they will be disappointed.

Judicial review day 3 - judgement day

The audited accounts do not show that............... it was for ARVO 13.4m by 31/05/13 plus interest £1.56m...... and the Cayman Islands register of Mutuals shows ARVO Master fund as registered 20/03/2012. I am sure there is a reasonable explanation though. Total owed to SISU investors by...

Judicial review thread - day 2

Yes he does but he doesn't say it didn't happen ....... his argument could be equally applied to engaging with two or more potential lenders or solutions at the same time couldn't it. Such situations happen frequently in business there is no law to say you cant even if the ethics of it are not...

Judicial review day 3 - judgement day

Has the claim of irrationality actually been accepted as grounds to bring this case? I still think the need to notify the EC or not is what must be proven by either side to win the argument. I am not sure it is as clear cut as some are making it. Seems very little evidence produced on this...

Judicial review thread - day 2

There was mention made of such an approach on pages 27 and 30 of the court transcripts from the Higgs vs SISU case. Not sure any document proving the approach was produced to the court but I don't think at the time the claim of the approach was rebutted in court either

Judicial review thread - day 2

Just been catching up on todays "action" in court. Still not sure where this is leading. The main point I thought SISU would press on was the proper notification to EC of the state aid but that seemed to be mentioned but no big thing on it. If they are setting the scene for court cases to...

I have not seen the full transcript of today and obviously there is more to come tomorrow but I can't help thinking surely there is more than this (I would guess I am not alone in that thought either) I assume today was just scene setting for the main points to be made in the morning.

So CBRE value ACL at 19.5m with the full lease and licence, at 8.4m with a rent of £200k and 6.5m with no rent at all. January 2013 CCFC still had the original lease & licence in place. Loan to value for the council should be 75%. Loan made was 14.4m which puts the value of ACL at £19.2m...

What the Judge said on the Higgs case “On the facts, as I perceive them, by the time the trustees entered into an agreement to vary the joint venture agreement on 14 January 2013, the transaction contemplated by the term sheet had already fallen apart or fallen away, to use Miss...

Was thinking that those figures didn't make sense too stupot. Turnover for 2012 and 2013 were 10.8m and 6.6m respectively and rents paid (was it all at Ricoh?) 1.7m and 1.2m respectively.
