ACL & Council need your advice....... (1 Viewer)

Following on from some of the content in other threads.

Assume that the scenario exist where, representatives of Otium / SISU (Not Timmy note) come knocking on the door of ACL / CCC and say they want a deal to:-
a) Return to the RICOH Arena before Christmas 2013
b) With the longer term intent to purchase the 100% ownership.

Consider if you were in a position and were asked to advise the CCC & ACL on what to do next. What would you be advising them?

I would expect them to enter negotiations. Only accept a fair rent. If they sold the Ricoh it should be its full value with the Football team attached.

I would also expect some clause in the contract around future development of the site and future sales...to protect Coventry City FC not SISU

ACL/CCC will never sell to sisu, at the same time I don't think if offered sisu would take it up, despite making out they want it.. Which makes me wonder what this is all about.

I've had my mind changed over the weekend based on a fair bit of investigating.

The strategy should be to have either a straight sale to CCFC or a road map for rent going into sale.

CCC/ACL should also accept the CVA and we should all lobby the FL to return the 10pts. (Despite what has been said by the FL last week, there is a precedent for this as the points were deducted for non-acceptance of the CVA.)

Sisu want out of CCFC but they can only reasonably do it with a stadium. CCC need to stop spending money on lawyers and get some more return on the arena complex. Sisu will sell up as soon as they have a decent asset to sell as they want to cut their losses.

Us fans should be getting both sides back to the table and talking to each other. Ideally in a locked room until an agreement is reached.

Other things that should happen: Continued investigations into the player registrations, asset movements and so forth.

I would also want the stadium to be locked to CCFC so SISU do not keep the stadium if the club is sold and then they charge rent.

Not illegal but is that not what a good hedge fund would do ? Unfortunately their business plan risks CCFC folding or becoming a small lower league club.

I'm pretty sure that that is incorrect.
Clubs must exit administration with a CVA accepted by creditors, otherwise the FL can impose a 15 point penalty eg Leeds.
Why they gave us only a 10 point penalty, lord only knows...guilt probably because they messed up the player registrations ?

After the last few months, I don't think this is anything to do with the Ricoh or football team. There are deeper things going on. Ask yourselves, why are SISU vehemently holding on to CCFC for dear life?.....They are losing money at Sixfields, hand over fist, and are willing to cover losses for up to 5 years??? If they had intentions to build a new Stadium, they would have got their arses in gear a long time ago, yet there is still no proof of build plans, location, and definite time scale!...The only definite statement has been said by the vast majority of posters....The Stadium DEFINITELY won't be built.

I'd expect them to offer a long term contract with a choice of either a sliding scale based on the league position or a fixed annual rent (haven't we been here before....?).

I'd also expect them to say "Look, we're the stadium owners, we'll concentrate on that, you worry about the football, and someone else can think about the sandwiches & cups of tea....".

Watch this space. Once Appleton has made his investigations public (19th Sept) things will start to happen. My bet is that meetings will be had, much in the same way that the Alan Higgs Centre is now back in negotiations with the club re: training after the FA/FL got involved.

A new owner will come in but only if they have a club and a stadium to buy.

Yes, currently your right. But I mean where you would be expected to be positioned on average.
Based on potential fans, size of City and history I see us as Lower PL / Top Championship.
The Future : Top L1 / Championship. Based on SISU discussing a smaller stadium outside Coventry and the expected fallout from 3/5 years away from Coventry and the missing kids not latching on to there local football team Sort of a Peterborough.

If a meeting is brokered based on discussions that would lead to a stadium sale, she'll have people there.

Sisu's stadium plan is their end game but what is the Council's?

You are close in a way.

Whilst in admin ACL were only allowed to talk to Appleton by law. He was supposedly running the club at the time. Timothy then stated that ACL refused to talk to him. Which was right by law, but the statement has fooled many. Since ACL have been able to talk to SISU Joy has been out of the country, but was here to talk to Nikki, who BTW has nothing to do with CCC or ACL. And Joy fed her with lots of crap as we all know. She never did her homework before meeting Joy. But strangely Joy don't have the time to meet anyone who can do anything.

SISU are the ones that always do the legal threats. If anything would have been done or said wrong against them they would have at least threatened legal action by now.

By offering the same deal to otium and engaging on the other aspects it puts CCfc and their owners in a difficult position. Accept and engage or refuse and lose another percentage of support having already disengaged 90% of the supporters

OSB58....Many thanks for finding this to show "The Bear"......"It is interesting to note Mr Fisher’s failure to mention Ms Seppala’s verbal statement during this meeting, made in the presence of her own lawyers that the only circumstance in which the Club would return to the Ricoh would be upon SISU assuming full ownership of the venue without any negotiation on purchase price.

That was categorically denied by Labovitch on CWR. Falls into the 'he said, she said' bickering, rather than 'fact'.

Which is what you would expect.
Other potential buyers of the club would need to know what they would expect from ACL should they be "lucky" enough to win the bid.
Ltd affairs were taken over by Appleton so nothing could come from talking with Ltd direct.

Yes Norman.....they were not legally allowed to talk to SISU. SISU were not supposed to be able to make comments either. But they did. And also remember they had just threatened to liquidate our club. Should they have just sat back and hope for the best? If they had and SISU had liquidate as they had threatened to you would have been first in the queue to blame ACL for everything.
