What next seems to have happened, or rather it
18 happened in parallel to this, and which may well be the
19 key to this whole unhappy saga, is that there seems to
20 have been a meeting of the Labour group of the council,
21 which is evidenced by some presentation slides which
22 appear at tab 101. And various proposals are summarised
23 and the history of the case is set out.
24 The passage I wanted to refer your Lordship to is
25 the annotated section at pages 512 to 513, where it

1 appears that a number of the councillors are recorded as
2 making particular comments, and in particular on 513
3 you'll see that there is a note attributed to Anne, who
4 we anticipate is possibly the current leader of the
5 council, but it may be some other councillor, it says:
6 "Deal with SISU when hell freezes over."
7 I don't know if your Lordship can see that above
8 "process". Then at the bottom, under the box, it says:
9 "Could SISU sell on to another shyster?"


This what is the key to this whole saga.

At the risk of being accused as a simpleton I put it to you that:

1. CCFC stopped paying the rent on the Ricoh.
2. ACL asked them nicely to re-start and to pay the arrears.
3. As a result of their failure to do so they took the escrow account monies and sued for the balance.
4. Shitzu decided to relocate the football club.
5. ACL then re-funded their loan as they were unable to maintain the payments due to the loss of the football income. Following which they were in a position to, and indeed did, offer reduced terms to the football club for use of the Ricoh.
6. Shitzu turned down every offer of reduced terms but instead issued a JR claiming "state aid".


Have I missed anything?

No.
Can I suggest you read the transcripts and then use actual evidence as presented in the court. There are loads of reports, emails and notes you can quote.

Just read all three days and it has taken me a few hours but I got there.

A lot of bollocks in there as you can imagine but essentially it's just a dispute between two companies oh how to run their business.

The loan was bought or 14.4m as we know but sisu thought they could buy it for 5m or less and wouldn't pay more. As a result they would get Higgs share and reduced rent.

Both ccc and sisu were going behind each other to YB so bad as eachother there but either side doing so isn't illegal just obviously bad for trust and moral.

Ccc got there first and bought for 14.4m and they expected ccfc to move out and have a vendetta against them. A risk they were willing to take.

Rent was agree after the loan was agree strangely I thought. It was agreed by ML and TF that 400k was fair and serviceable but JS stepped in and said no for no apparent reason other than lack of trust and being an arse. The ccfc directors didn't have a problem with this. Tim fisher isn't the problem it's JS. She is an egotistical woman who has been beaten to the punch and she isn't happy.

The trouble to all this is the club is certainly no closer to a Ricoh return. A 200k rent can be offered and this is great for ccfc but JS is too deep in now and can't back down for fear of her ego. This is a shame as 200k rent is awesome value and would include match day revenues.

The judge will hand down the verdict June 30th week. He sounds very much to not see the case for state aid being used and will probably just dismiss the case as having no winners and that each side pay their costs and he sounds a really fair judge. I'm hoping and it sounds like he will tell them both to stop messing around and for ccfc to accept the lower rent as this is better than losing millions and no ambition in Northampton.

Sisu won't build another stadium this much is a given as it always was. No mention once of a new stadium and it simply won't happen.

ACL was going bankrupt as was ccfc and both needed to be restructured. ACL was with the loan and ccfc have reduced the wage bill and cost cutted themselves. They actually both now need eachother more than ever with ACL receiving circa 200k rent and ccfc gaining big gates and merchandise revenue etc.

Expect movements after the verdict on June 30th. Whatever the result something will come from it. A solution maybe not but maybe so. The judges decision will force someone's hand so something would have to give.

Sisu win and loan is repaid then ccc hand is forced to either liquidate or refinance loan with sisu. They won't liquidate as stated in court there is no rerun for shareholders that way as no major creditors.

Ccc win and sisu are forced to act. They have no chance and no realistic appeal chance. A rental offer with revenues is only option but it's a good option if they can get past trust and start again. It's that or carry on in Northampton which won't happen as it serves no point now.

Sounds about right to me. I too read the transcripts. There is no 'smoking gun.' & I kept thinking us fans weren't very far off months ago in our thoughts on what was happening. No big mystery. For all the waffle.
Whether the judge will rule for a technicality of European State law being broken, who knows.
If we don't get back to the Ricoh after June 30, you have to seriously fear for the future of our club.
It isn't universally popular, but a contingency Coventry team, playing in Coventry, at the Ricoh, may be an ever increasing possibility. The very existence of such a team may force Sisu's hand.
But two seasons away from Coventry would be a deathly blow. Something has to happen.
