You seem to constantly be getting irritated by people going off subject within a thread ? But that is something that will never change. Any debate will morph as more people input. As it should. Each person will bring there own perspective that to others will seem irrelevant. Trying to stop that drift in thread content makes you King Kanute-esque. I suggest as moderator you have more important thing to take up your time.

Only if its going off topic in a direction he doesn't like.

This thread is like that Brass Eye episode about paedophiles. And I think we just set light to a paediatrician's office.

Companies house are probably too busy bullying the small self employed folk that keep this country moving rather than those who have the means to fight back.

To be honest, I have given up with things going off topic and just let them run unless offensive or OTT. Some people will never just understand how forums work

We could do with a computer programme that picks up on several users names.
We would then know that the thread has gone off topic, become offensive or OTT.

thats about right.. most small business owners would fill their pants when they get letters like this from Companies house, but again i say, if you know how to play the game you get away with what you want to..

i was told by my accountant that these kind of letters are automatically issued, and its very rare for comanies house to take action until the very last resort.. they will keep issuing letter after letter until it gets to a very extreme certain point.. now , if ive been told that as a small business owner.. then im guessing SISU have someone who know a hell of a lot more... and they know exactly how far they can pish it before it gets to anywhere near them being actually prosecuted!

To attempt to get back on topic, SISU's two defences to (this year's) unfiled accounts saga are:

1. It's all the fault of those nasty people who set up the structure in 1995
2. It's all ACL's fault for rejecting the CVA and so making the administration/liquidation process more protracted.

If we could allow some facts to intrude:

Otium Entertainment Group Limited (Company number 07612487) has not yet filed its accounts.

Otium is a new company set up by SISU. It was not previously part of the "CCFC group". It was certainly not part of any structure set up in 1995.

The latest legal deadline to file Otium's accounts was 21st January 2013. They could of course have been filed months before this - but this was the legal deadline. This deadline was a couple of months before the administration process for CCFC Limited started.

So explain to me again why the accounts haven't been filed......

I am thinking they are deliberately holding them back until the admin/liquidation situation is over. Would there be any recourse then ,once all has been dealt with, if the accounts show the assets were moved to leave only the lease in Ltd. So Sisu could liquidate Ltd and terminate the lease?

The Otium one is particularly baffling tbf, as there surely can't be anything much odd in their accounts worth holding back on them, being as it's been dormant for god knows how long!

Not for that long - it was only incorporated in April 2011 !!

If assets were moved to deliberately put them out of the reach of creditors, that would be illegal. Whether the accounts were filed or not, the Serious Fraud Office could still take action to bring the directors to trial for insolvency fraud.

if that happened we should have a charity football match for them at sixfields to help pay their legal fees. just to show them how much we have appreciated their ownership of the club.

Indeed.

Frankly that raises more questions in my mind than the lack of CCFC accounts. I can see plenty of reasons why they may not have been filed... but struggling here.

And if there's not an obvious answer, that makes me suspicious.

I can come up with a damned fine conspiracy theory, but little in the way of a theory that holds together properly

I normally subscribe to the cock up theory of history rather than the conspiracy version - but as you say, why would they not have filed them.

One phone call to their accountants and a couple of hundred quid to do the necessary -assuming that it was dormant.

Odd.

Their original reason for not filing accounts was with the on going rent dispute they could not offer a realistic forcast.

However now they have an agreement to play at Sixfields, they can bolt on the missing forcast....bet they are in the post already...they are in the post aren't they Mr Fisher?

Aaahhh the postman has lost them. Ohhh naughty postman!!

Not odd really. It fits the pattern of their arrogance and a belief that normal rules of law and socially acceptable behaviour do not apply to them.

This could be relevant. Are they hoping ACL fold before they drop a bombshell with the accounts.

What actions would there be if ACL folded then SISU show the asset movement (Players) was done during this period.
Are they breaking any laws ? They would I guess if they had after administration was called.
But if it was between the last accounts and the administration process, would it ?
There would be fury but from everyone with SISU but it would be too late for ACL.
Has this been there long term plan? Have ACL been caught out thinking the assets were in Ltd.

Imagine how complex it must be! They have to account for toilet rolls, bread rolls, champagne...& once they have eaten the rolls & drank the champers, they probably think "Ah, f*** it...the accounts can wait, let's crack another bottle open & worry about the accounts tomorrow - or next year!"
A car company with toilet rolls, bread rolls, champers & 00's of 000's of other items to buys & 00's more employees/contractors wouldn't get away with - how do football clubs???
