Didn't it come out in court that the original investment is now effectively written off?

Yet fisher says there will have to be an appeal because the mean judge said nasty things about sisu.

This exerpt is from the write from the CCLSC meeting with TF last Thursday, and may be of interest, as he is stating that the legal action is nothing to do with the club (Otium).

The judge had made a number of damming comments about SISU in his judgment which cannot go unanswered. The appeal was out of the club’s hands. It was explained that a new governance structure had been established for the Portfolio Company and Otium was subsequently at arm’s length from the legal case. In effect Chinese walls had been put into place between the Club and the creditor/investor.

Ah - you've got to laugh. There's no way that you can separate Otium and SISU - all of the same people are involved, under the ultimate control of JS.

The club can't expect ACL to have them back at the Ricoh whilst the court case is in play. It doesn't matter how damning the verdict is, if they're serious about coming back SISU will have to drop the case.

It is, by the way, the oddest response to a court decision I've ever heard. Basically what they seem to be saying is we lost so badly that we've got to try again (i.e. we lost six-nil but that last goal was borderline offside so we demand a rematch). It would make more sense appealing if it was a close thing, surely.

Two out of three judges who have dealt with this case have bounced it out entirely without ceremony - why they think they're going to get a better hearing from the next three beats me. What's that saying - "History repeats itself first as tragedy, then as farce".

Love that line " we lost 6-0 but the last goal was boarder line offside so we want a rematch"

haha brilliant.

It does seem this way however that even TF has admitted it was a battering basically that an appeal was inevitable just to same some face. I feel a tad sorry for him sometimes he has to do what his employers tell him yet he must look at it and get home at night and think why me?

I thought that and wondered if thats why a hold was put on the liquidation, Presumably they are there so that there is more damages to sue for if sisu win.

Is Nick the Fat Controller?

I looked up a Chinese wall, I think as duffer points out that the people involved are the same, it means--- absolutely nothing....
A Chinese wall is a barrier that separates two or more groups, usually as a means of restricting the flow of information. Typically, the wall is purely conceptual,

All eyes on August 7th, lets say the football league decide to get tough.

They still have to settle how much of the £590,000 SISU have to pay to ACL. If they decide all of it and Joy says `no we will take the FL to court`. The FL announce a breach of rules and dock 10 points or more, this scenario makes the quality of any new signings and make weights insignificant.

Or if they say it's led and ACL stick to their policy if no talks until £590,000 is paid then we have no real hope of a return at all.

There is already enough hysteria on this forum without these highly unlikely situations being posted.

It will be relatively cheap if the End game Is achieved .

Say £400k to CCC when all Is Exhuasted plus their own Fees.

The playing side Is covered this season and cost them £600K In equity for last season ,with potentially some more In the form of Arvo loans

No I will not be happy but I'm sure you'd rather we didn't go home if ACL don't get the dosh.

I'm not bothered about what circumstances we come home so long as we do. The £590k is a barrier and the only sure way to eliminate that barrier is if ACL get paid in full. Unless you know better?

I really can not see the sides sat around a table under any circumstance at the moment, unless there`s new players from SISU's side.

The football league will decide. If they decide £300,000 I assume you, like me, will demand talks once that amount has been paid?

If they decide £590K, do you think it will be paid without any quibbling?

It will be interesting to the see the reaction if the FL decide on a figure less than the 590K, and ACL then continue to refuse to discuss a return to the Ricoh.

no it won't, ACL have already said (completely reasonably) that they won't discuss until the JR is dropped,

The sooner the club gets away from the grip of ACL/CCC/SISU the better.

it will be interesting if the FL decide on ANYTHING. A lot of us hanging our hat on Thursday, sadly, I don't expect any outcome, as they will need another meeting to decide on the amount, after Thursday confirming that an amount needs to be paid.
