good start.....but as the next £150K is due on Friday anyway, I would have paid the lot in one go.....save on the bank charges innit...

Good start, Nice to see SISU are not above the law and have to pay these costs and not squirm out of them. Another 150k due by Friday which is nice. Thanks Joy.

Interesting there is no appeal at the moment and only have until the 15th to appeal. If they were to appeal does anyone else like me think they would of appealed yet or they are genuinely wanting to come home with the 7th being the date the FL decide the monies owed. That would fulfil the criteria of no legal action and monies owed settled.

I am cautiously optimistic about this.

This is good news Jack as the monies owed is decided on the 7th so I reckon that's within a week to do a deal.

I expect my bins to be emptied early this week then. Also, they can sort the Albany Road out in Earlsdon now. It's a death trap.

simon have you been told it's the 15th or have you added 3 weeks onto the 25th? because the judges letter on your page is dated a week before. If you've been told 15th thats a shame.

You are very optimistic, but I think the player sales & Arsenal cup tie money that came in to the club will enable SISU to hold on at Sixfields at least this season.. I don't think they are going to give in soon, only if ACL pull a flanker & look like lining up another anchor tenant or something, but that is unlikely.

I don't disagree with your comment there but can I get your opinions on these 2 things which I actually believe.

1. What would sisu gain from staying at sixfields now? before it was to distress acl and make them out to be the bad guys but 99-100 fans see it now as proved in court. They would achieve nothing from staying there other than loss of income. Before it made sense to them for their reasons but now it doesn't. Even with the money in which is great for them it just doesn't make sense to me.

2. Why have sisu released these open letters etc. We have heard nothing like it since I can remember. It was full of actual sense for once with no bs like we are building our stadium and balming ACL which they always do. Why do this now unless it was genuine? People tell me to increase tickets sales etc but it doesn't wash as you are going or not as seen. A soft statement from bully sisu isn't going to change that.

Overall I think its all positive, they are paying on time and currently have no appeal on the table which means there is no appeal and when money is paid a deal can be done with just enough time to get back for the season start.

As much as I hate sisu I would buy a season ticket like a shot as its the team I love and support playing where it should be.

I don't agree that with no appeal currently on the table that acl will treat it like there is no appeal, at least without sisu publicly stating that they won't appeal, or even better signing something to that affect, unless they do at least that acl will have to assume that an appeal will be forthcoming untill the final date has passed, especially since appealing as late as possible to drag out precedings has been sisus MO the whole time.

That's what we've been told.

Not sure what to make of the date on the judge's letter. The day we published online was the day we found out. We also, strangely, found out before the council, so maybe the date isn't when it was "handed down".

ACL would put markers in place im sure but if there is no appeal then WHY NOT?

I don't think anyone should be getting excited. Unlike the FL when the judge orders SISU to pay something by a set date they have to meet that date. The £100k had to be paid so it was, the £150k will also be paid on time as will whatever the balance is that the judge declares as CCC's final legal bill.

There's no good will, SISU didn't have a choice and it doesn't bring us any closer to a return home.

If sisu told them in a legally binding way there will be no appeal then acl can act like there is no appeal, otherwise they will act like an appeal will be happening, anything else would be naive folly on their part. Especially as everything suggests sisu will appeal, after losing the JR Fisher said 3 senior judges would give them a different response and we haven't yet got to the stage with 3 judges so there is every reason to believe another appeal will be happening.

If there wasn't to be an appeal it would be in sisus interests to announce it straight away, it would increase the fan pressure on acl and less people would see sisu as the main roadblock.

This is obviously money coming out of the club and not in remember...

I hope they dont appeal but i think they will, the appeal normally drops in last minute when you think it is all safe. To what that appeal will solve is a different question.

You're having a laugh mate.....the council tax payers will see none of that cash re-invested.....it'll go straight in CCCs back pocket....blah blah blah..

Like Covstu says what would the appeal achieve though? In short Nothing. Yes it may distress ACL what not really, its only the leave to appeal anyway just because they appeal doesn't mean it will be granted as even Justice Higginbottom said if sisu went to the court of appeal he has no doubt they will throw it out as well.

All seemingly pointless now. When the Ricoh is sitting there ready and waiting. Oh the frustration.

Surely if they were going to appeal they would have done it by now. In my opinion they will use this in any discussion after the money owed to ACL is paid on the 7th August, and this gives me a little chink of hope that something could be worked out about bringing the club home to the Ricoh.

If they were certain they were going to appeal come what may, they would have done it by now

Thats not been the case in the past, they have always taken pretty much as long as was allowed to appeal, if the plan is to drag this out as long as possible to distress acl then it's in their interests to always appeal as late as possible.

On a football side to this by Friday august 8th that's 250k with more expected to be paid to the ccc reaching around 4-500k in total from what we are told then this 500k could of kept Murphy? Moussa? Marshall? and also brought in better players as more to offer or a bigger squad. Very frustrating.

Or a year or 2 years rent at the ricoh with ticket sales and sponsors and merchandise?

KoK, I didn't think moving to Sixfields was rational or likely, don't ask me even to pretend to understand Joys mindset...

But my gut feeling is that if CCFC has been stabilised financially then I reckon SISU will tough it out till the FL show some balls & actually sanction them & I believe that will not be till the end of the 5 year period, so 4 more seasons to go.

Yeah, I'm miserable & not optimistic, but won't be upset if I'm wrong.. it is only guesswork after all

it shouldnt be coming out of the club. it should be sisu shouldnt it??? didnt fisher say there was nothing the club could do about any of this court action???

Actually while the 2 documents have the 18th on them I've just noticed that on the one that has been stamped by the court the stamp has the date of the 22nd

My understanding of it was that the £100k actually had to be lodged with SISU's solicitors against possible costs, prior to commencing the action (sort of an escrow, in effect). So in essence these funds were simply released. If they hadn't been, I presume that SISU's solicitors would have been in trouble as much as SISU themselves.

The next £150k by 8th August will be mildly interesting - will SISU drag it out? It will be accruing interest, so in theory it would make sense to pay it ASAP, but it's SISU so who knows!

This exerpt is from the write from the CCLSC meeting with TF last Thursday, and may be of interest, as he is stating that the legal action is nothing to do with the club (Otium).

The judge had made a number of damming comments about SISU in his judgment which cannot go unanswered. The appeal was out of the club’s hands. It was explained that a new governance structure had been established for the Portfolio Company and Otium was subsequently at arm’s length from the legal case. In effect Chinese walls had been put into place between the Club and the creditor/investor.

Thats what the court document says duffer, the judge ordered that the funds held by sisus solicitors be released.

The Claimants shall release to the Defendant within 7 days of service of this Order the
sum of £100,000, together with interest accrued thereon, which is held by the Claimants
solicitors as security for the Defendant's costs, in part satisfaction of the order in
paragraph 5 hereof.

and

The Claimants accept that, in principle, a payment on account of costs should be made.
The Defendant has indicated that its actual costs exceed £580,000. The Claimant has
raised issues, especially concerning the costs of the second Leading Counsel and
expert. It has offered £100,000. However, in my view, the Defendant will recover in
excess of £250,000; and I have made an order in that sum. I have directed that, in part
payment of that, the sum held on security for costs is released.

I find them complaining about the costs of the second lawyer for the council amusing when they had a full team of lawyers.

Well that that shows unequivicably that sisu will be appealing further, there really is no hope of us getting back to the Ricoh over the next couple of months. :-(

Seems you are right but I would like to think something can be done. If there is no appeal and money is paid I don't see why it cant be sorted.

Obviously there cant be an appeal else why would you deal with these people. Well you wouldn't.

By the way they can try to appeal but 99% it wont be granted.

Well if that's the case then Otium/SISU better hurry with there plans for the new stadium and pretty quick, sure the FL (the gutless wonders) will want to see this too.
