POINTS REDUCTION - a tad unfair methinks !!! (2 Viewers)

I can't help but think that the two innocent parties in this administration debacle (the fans / the players) are affected disproportionately in suffering the results of the main protagonists criminal negligence in running CCFC.

Having purchased my 49th consecutive Season Ticket and Car Park ST at the beginning of the season I naively expected a reasonable return on said investment like 23 league home games plus cup participation unaffected by outside influences.

Management staffs came and went, players were hired and fired to create at last some stability, hope and optimism certainly with the last two managers, MR and SP providing a brand of football we could only dream about last season.

This has resulted in us potentially having a reasonable chance of finishing in the top six a feat last witnessed over 40 years ago.

But a big fat NO in the form of a 10 point reduction will ensure mid table mediocracy with only pride to play for with the players and fans totally innocent of any blame whatsoever.

My point is can there/is there an alternative method of punishment that does not impinge so manifestly on player's efforts and commitment and fan's loyalty and expectations but penalises the true guilty.

Why not seek personal financial redress from individual board members/institutions/interested parties etc that directly influenced this mess and not penalise the innocent

Problem is ... Who would you sue?

Board members who would be acting within the remit of sisu?

Sisu who are acting on behalf of their investors?

Or the (real owners) investors who only sisu know who they are?

It's a limited company, individuals within can't be held financially responsible, and it's in admin so there's no cash to be had.

It is unfair for us, but we are looking at it from our own perspective.

Basically we've been fielding a team we can't afford, therefore we have gained an advantage over well run clubs.

Not exactly true in the modern day, I have a limited company and I have had to give personal guarantees.
The directors of any company can be held responsible for anything the company has done.

Everyone plays by this 10point rule...yes it's harsh when you suffer at the hands of it - but how many of us have scoffed at Leicester, Pompey, Saints & co when it's happened to them :-(

Are you sure about this? What about arguing in court that SISU's board members are ultimately responsible in practice, and bringing some kind of prosecution against them for corporate irresponsibility / negligence?

Exactly. It happens to other clubs, nobody cares. It's the rules, we didn't abide by them. I don't like it, but it's fair.

I used to think that the points deduction for going into admin was a bit like the league kicking a bloke when he is down - increasingly, my eyes have been opened to the cynical financial abuses used by some (by no means all) clubs - starts to make more sense

unfair on the fans

I sent a thread earlier in the week with the same theme the fans have basically been conned out of monies and led up the garden path.
We should sue the football league and they might then sit up and take notice that they should have controls/audits in place as it is of course there league we play in and the way clubs are run should be checked on a regular bases with audits etc as what happens in business with banks.
Apparently there are checks in place to make sure the companies concerned at the start of a club buying process to make sure they are fit and proper to run the clubs before the green light is given why does the process finish at the start?
If there were regular ongoing checks then any dodgey movement would be picked up and questions asked and dealt with before we get in a situation whereby currently we are docked 10 points which could be as many as 30 and even expulsion if the owners have been up to 'no good such' as Luton a few years back
Why should the many thousands of Cov fans and players suffer because of a handful of people in a board room that possibly cut corners if this turns out to be the case (hopefully not)
I think we all remember last year when Mr Fisher explained they were 'moving finances around' and again quoted something like 'normal business practise' why at that point did the football league not investigate what SISU were doing and then polity say 'not allowed' 'what are you actually doing please run this past us'

The rules are there for everyone & those that break them get punished.
If someone is a murderer - should we not imprison them as it is also punishing their family?

We broke a pretty significant rule & we're docked 10pts...it hurts...get over it!

You could in theory also blame the players and the fans.
If the players had performed at home as they did away and to their full ability then ......
The fans who only turn out when the team are doing well would be there for every game ......
Then the team would be correctly financed by the increased income and losses would be minimised or removed.

To make a case for misrepresentation you'd have to demonstrate that you were induced into buying because of the false statements made by SISU. I think you'd have no chance - but put it to the test - go and see a no win, no fee lawyer and see what they think.

Although, if you won you'd only become an unsecured creditor.

Spencer, agreed but can you imagine the hassle it would cause cause if a 1000 season ticket holders said they were taking the owners or the FL to court?
Am sure some up and coming young lawyer would enjoy the challenge.
If we won I would feel so much better even though no money involved, but if we lost it would feel a success just to get to court.

I totally agree with the idea, but how many cases do you think exist in the FL where the person named as owner / director are not the same person actually holding the power or putting the money up, but the named person is just there as a puppet because they would be more acceptable to the authorities? Its just impossible to police.

The most annoying thing about our current situation is that SISU have got us a 10 point deduction and ruined our promotion hopes, and they are still at the club - talk about the worst of both worlds!

Its the rules that we play under and agree to every year when we sign the liscence agreement with the Football League. Just like T+C's on any website. Sometimes the consiquences can be very unfair but deserved cus we agreed to it, so we should have known better

I wouldn't recommend a lawyer though - they'll just charge and get you nowhere.
