Did he really come out with this? Unbelievable. No wonder he gets on with Fisher if this is the way he thinks.

Maybe we should all sue him for the stress and upset he's caused us.

NTFC will apply to court for their costs to be paid by ACL. They will enter a claim that includes every related cost they can think of, (as would anyone else, so no wrong doing implied by that). The court will then via a process called "taxing" decide what is and what is not payable to NTFC in respect of what it has cost them to defend. I would have thought that very little legal argument has gone on and if you throw in a few Barristers costs on the NTFC side that the claim would be less than £20k. Any compensation for lost business or hurt feelings is entirely seperate and extremely difficult to prove because from the start hardly anyone took ACL's claim to be likely to succeed

Any money awarded to NTFC will add to the 'legal cost' of ACL. At some point someone is bound to ask questions about the amount of legal costs and ask questions of what has been achieved by those costs.

Got to ask that question of both sides in fairness havent you? (ACL & SISU)

Legal & PR costs for ACL could have been better spent on the arena etc

Legal & PR costs for SISU/CCFC could have been better spent on the club & team

only the lawyers and pr guys win it seems to me

probably but if it is paid out of cashflow is taxpayers money involved? So long as CCC are not paying the costs then the costs fall to be funded by ACL only. Do the legal and PR costs affect the value of the ACL company ? if not then what is the loss to the taxpayer? Have ACL set aside a fighting fund out of accumulated cashflow and stuck to a budget? We just dont know but I dont think CCC are funding the costs unless someone shows me differently.

I wasn't accusing them it is just whenever anybody mentions ACL losing out on anything then the tax payer argument always comes out as a defence. I think they are all as bad as each other to be fair and trying to willy wave with their petty legal things.

You always have a pop at osb, just wondered why that is pal. Plenty of posters spout crap, don't think osb falls into this category. Tbf I understand a lot more about our situation because of his contribution on this site.
Just curious

Does anybody think the real reason for not pursuing the court action is that ACL can't afford to?

Not really. More it's an idiotic case with no hope of succeeding, intended solely to hold various parties to ransom, distress them a little, and prevent them from moving forward with their future plans

I think thats part of it fp they wont have lots of surplus cashflow to fund it thats for sure. I also think that continueing with court actions leaves ACL open to scrutiny and having to explain themselves. I am sure right now SISU would like that scrutiny but ACL staying quiet, not instigating or pursueing court actions frustrates that to a large degree. That leaves everyone guessing as to the ACL financial position.

It's possible, but what worries me more is that they've decided to "Move On" and are working on doing something else with the pitch area, be it another team (as unlikely as that seems) or something. That would then prevent us (or make it a hell of a lot harder) for us to go back to the Ricoh if we don't build this new stadium. So I hope Joy, Mark and Tim weren't bluffing about a new stadium and Tim wasn't sitting in the badger droppings for nothing.

Habit i suppose.

As far as the football club goes i couldn't care a less. Sisu have killed it. I won't be watching on Sunday,id rather mow the lawn. I have no feelings*of joy when we win i even chuckle to myself when we concede. I hope they lose later and i hope they get stuffed on sunday. Sad really that this is how i feel but its not my doing. I dont see the team as ccfc but more of a sisu eleven. I hate sisu more than i love the club.

Ill be at Wembley on Friday cheering on a decent team of internationals. A team that i actually feel part of.

Sisu can piss off to the moon with their club.

That's if you believe the line about the court action being in the interests of bringing City back to the Ricoh.

For me it could have been about demonstrating a breach of the lease by CCFC ahead of a re-run of the administration process, the idea being that the administration process would show ACL as being the biggest creditor by using the remaining term of the lease as the value of the monies owed rather than just the outstanding monies from the rent strike.

When there was a lease in place surely a court case would have legs due to someone taking on business with SISU who had a lease elsewhere and owed money for it.
Once the lease goes then so does the court case.

I think ACL have to make plans for life without CCFC at the Ricoh any normal business would. It is anyones guess as to how far a long they are in the planning process or whether any of the plans are being implemented. YOu would have to think that they have been planning since January wouldnt you? The larger events will have long lead times but not all events will. I would guess that even now any CCFC comeback would be affected by alternative events that have been booked. Does that preclude CCFC from coming back - no but it might affect fixture lists etc if they did come back.

Buying the freehold wont remove the ACL right to trade at the Ricoh for another 40+ years either and if ACL viable without CCFC that could still leave the club homeless or paying rent to ACL.

By ACL taking the action they are trying to get CCFC back playing in Coventry.
Surely that is what you want also, isn't it ?

We need to get ACL and SISU back together so why do you continue to try and keep them apart ?

At some point in the future (not to distant I hope) I see SISU as a partner in ACL.

Stop blaming everybody and continuing the fight. Do something positive and work on getting them back together !!

I despair

So by OSB's reckoning it was a £20,000 "gamble" to try to force the numpties at SISU to their senses and drive a leverage point of anxiety between CCFC(SISU) and NTFC in an attempt to bring the football club back home...and I'm supposed to be ciritcal of that action for fear of being accused as an ACL sympathiser?
I'd say it was a reasonable gamble, does that make me disloyal to CCFC- some might say?... hindsight is mans best ally.
I guess SISU would also admit to regret not paying the rent(or at least part thereof) wouldnt they:thinking about:....wouldnt they? :thinking about:

My guess would be two possible reasons for initiating this from ACLs point of view. Firstly the hope that Cardoza would get worried and back out of the deal, forcing SISU back to the Ricoh or possibly that by doing this they removed the possibility of Cardoza being able to claim no knowledge of the existing lease if ACL did decide to take matters further.

I'd probably watch if they qualify.....but I couldn't give a fuck if they lose all group games 10-0.....it'd almost be worth it to see that big man JT blub like a little baby girl...again.

....I don't actually want them to lose though.....that would be just a bit too bitter...don't you agree?

Don't know about you but I've seen every one of those players play against City apart from Rooney. They're hardly heroes, again, Rooney aside, they are 3 complete and utter cunts.

Bizarre how you take some moralistic approach about not watching City but then name John Terry and Ashley fucking Cole.

My builders would probably be delighted to give them a quote and then take ages before they actually start to do anything after it's accepted.
