Hi all. Is anyone good with panning laws and advice on what I can do.

Back story 6 houses have been built behind us.

Other the weekend the builder has come in and removed the hedge from behind our fence that offered as privacy. On the planning the builder was suppose to fill in the hedge not remove it. The builder has done little to none of the landscaping for boundaries.

By removing it I has now left us exposed to two downstairs windows and 1 upstairs. On the plans the upstairs should be frosted. it isn't ! The plans for downstairs showed the two side windows as a W/C and utility. But the builder has changed the layout so one of the windows is now a kitchen window. This wasn't in the plans.

Due to the levels the houses windows look over our fence and in to our kitchen and dinning room. The upstairs window looks in to our bedroom.

Looking over the originally planning the council have realy not done any sort of impact for the existing homes. What do I do ? I assume I need to talk to the council planning department about the windows and enforcement for the hedge.

On the side profile you can see it shows a hedge that is about 8-10 foot. But now there is just our fence thats 6 foot ish. So the plans are pointless

Have a look at the approval notice / officer's report from the council, there is usually a list of conditions that the builder is required to meet

Thanks. I have and there is a load of landscaping that has not been done and even a 5 year plan for landscaping maintenance. I guess will need to speak to enforcement and go form there.

it looks like the council when they granted permission did not take in to consideration our house.

Yep, raise it with the planning department.

You should’ve been consulted as a neighbour anyway if the property adjoins your land. Did you raise any concerns?

The planning was granted before we moved in. The plans changed a few times during our buying process.

I will look over our legal pack and see what the searches said.

But the now kitchen window was suppose to be a utility and that was part of the reason they could have a low window and the window upstairs should be frosted.

If they had not cut away the hedge we would not have really worried as could not see in to our house. We no have 0 privacy.

Could the hedge have been removed to do the outside landscaping and is due to be replaced with a fence or similar? If you're feeling particularly brave you could talk with the builder about what's happening there and while at it mention the non-frosted window etc. It may result in a more amicable resolution.

If you try that and they just ignore you then only option is complaint to the planning department.

I spoke to the builders office the other day. They claimed it was removed for a Shed. The original plans have a shed on plans in a completely different location and did no involve removing the hedge. The landscaping plans state that all hedges removed should be replaced. So they clearly have no intention of this.

This also differs to the person who cut down the hedge stating it will be used for parking. So something is going on.

In the plans it says the builder needed to complete the landscaping and some fences before anyone moved it. Yet 2 houses are now occupied.

I will speak to the council tomorrow to find out more information. The removal of the hedges have resulted in 4 houses losing privacy.
