I think it's more about the council using the PR firm by proxy through its directors on ACL's board. They have circumvented FOI or other scrutiny in doing so.

I thought escrows should be under the control of an independent 3rd party, are they saying then that the FA were the body that could give permission for drawdown?

I really wasn't on about the escrow - we all know it was there and it was used. Nothing new and nothing criminal.
I was simply saying the language between the two reporters is different.

They don't control ACL though do they? They've got a 50% shareholding, and a couple of seats on the board.

Regardless, I'd rather all of the sides were completely open and disavowed PR companies (and also World Peace and a bigger salary), but I don't think there's much chance of that at the moment.

Has the lines of argument become clearer now?
CCC QC saying they made a decision based on information they had.
ACL QC saying they were given that information because it didn't fit criteria of state aid.

Nobody is admitting state aid law was breached.

It will come down to Judges interpretation and knowledge of the law....he will be well prepared for this case and be able to research further if necessary.

Hey, hey...Mark Labiovich – who in some ways could take the 'credit' as the architect of today's proceedings – has just arrived with an as yet unidentified other person.

I have to say, I am so tempted to pack up my things, rush to the front of the court and yell to the whole room that everyone should realise that all the people with the power to end this dispute are here and they should just get down to negotiating a solution.

I'd take the overnight stay in the cells...

ACL QC says this is the first state aid case in an English court not concerned with tax and regulatory matters. He thinks it is the first to focus on the private investor test. There have only been a few state aid cases in English courts

And that is why a jury sometimes struggles....they switch on and off at the wrong moments and don't always focus on the right things.

Three days using the judge as arbitrator. Could have been productive.

Just a thought on the profit from the loan to ACL. Is the considered in the context of real term cuts in the central government grant to CCC over the next few years? It is a notional profit on the loan that would probably be swallowed up by cuts.

Why don't they all go down the pub after this and sign a deal to get the club back at the Ricoh?
