New protest venue and date?

Easy to get to

Does not involve Northampton or the Ricoh

All relevant parties who we want to see the protest and the media would be present in one place at a set time?

They did not win anything. The result was claim not upheld, counter claim dismissed after a short time.
No damages/costs payable by either party.

Same judge for the Higgs proceedings.

I felt the judge would not accept lies or propaganda. He would slice through the rubbish.

He very quickly came to a clear, rational and fair decision accepted by all

I want a strong judge and a quick and fair outcome.

Plus he has now got a lot of the background which will speed things up

So are you saying Higgs were right to bring an action that ultimately they were ruled against and that SISU owed them no money? Really think of the legal costs and think of the children.

Nice to see you leaping in with both feet though.

I wish sisu hadn't lodged the counter claim - which was clearly just a strategy - as then you'd really have nowhere to go with this would you?

What happens when a charity seeks legal advice about a debt owed?

Can they ignore the advice?

What I don't get with this, do the same people advise AND represent? ie couldn't a lawyer advise them to take it to court, after all they are getting paid silly money for being in court.

Ah you mean Mrs Justice Thirlwall who granted the JR? I would hope that the judge whoever they are, will look at the facts and hear evidence before making a decision. The fact that a JR is granted doesn't imply wrong doing by the defendants, that's what a JR is there to determine.

It's an utterly fatuous argument this 'Higgs didn't win so they shouldn't have brought the case' one.

Given it's also made by someone who openly admits he couldn't care less if the Higgs or CCC lose money as long as SISU get the stadium, I'd just ignore it mate. It's what I do.

counter claim was a bonus sisu went for

the main claim was brought forward by higgs and they lost.

The June 10 judicial review is likely to see the council represented by James Goudie QC, while Rhodri Thompson is understood to be due to present Sisu’s legal argument after he represented the club’s owners during the latest hearing.


Thought Mike O'brien had said he was going to defend the CCC .

Expensive bonus to get thrown out then given they each paid their own costs and for at least the first day (when the counterclaim was heard) Sisu had 8 on their legal team.

Sorry thought you asking if I was there, as in to say how can I say I want the same judge if I wasn't there. So I was explaining what i liked about him to quantify my comment.

I wasn't there, but I could see why that would be intriguing if I was.

It costs SISU a lot more to do their counter claim.

I don't think the counter was as some say just to get documents in the public domain.

I believe it was to force the charity to back down

He definitely gave the impression he was, I was impressed at how quickly he seemed to grasp it all, disseminate it. Break it down to what was relevant what was bluster. Then from what was relevant deduce a speedy hypothesis. Each party accepted it and all seemed a bit reluctant to challenge him.

Could have gone to Small Claims Court Wingy however Sisus counter claim amount was higher than could be dealt with in the SCC I'm sure that wasn't intentional!

Sorry my post was referring to Sisu winning their appeal to get a JR and the judge who granted it. Higgs case was a 'nil all draw'.
