Think Sisu could have counter claimed for millions but judge might be more inclined to dismiss for a silly amount. Higgs may well just be limited to £29k.

What about the evil hedge fund reneging on it's obligations to a charity?

Or the evil hedge fund massively inflating it's costs in said counter claim?

They're still OK right?

Absolutely - sorry I was talking about the threat to the Trust based on them simply linking to the article.

I think it's clear now that SISU aren't going to take The Guardian in court, so clearly it was all about threatening the SBT to keep them quiet rather than actually challenging Conn's article.

Are you certain? I thought you had the options of admit liability, defend the claim or issue a counter claim.

Haha! If I weren't writing to you lot Id be asleep!

20ft square room, mainly taken up with legal people, 12 people watching sat at the back, all in suits/'business attire'.

This makes a council meeting look like prime time viewing.

The case & counter claim is about establishing whether the evil hedge fund did indeed renege or whether the charity did - try and retain some balance eh?

The counter claim does appear excessive though there may be some legal reason behind it.

The point I was (badly) making was that the mere fact of a counter-claim wasn't what had people up in arms. Hence Godiva's rather patronising post didn't make sense.

Of course, it's all up in the air, we know nothing. I'll go back to lurking then (unless anyone else has some allegations about the pensioners in my family).

If the judge decides that there is no legal case, then what relevant evidence can there be? If there are grounds for a case, then bring in the evidence.

serious question. is it normal to do that before the case against you has even been heard? i would assume you wait for the result first to find out if you have a case for counter claim.

I'd like to know this. Seems a ridiculous law to me, but wouldn't be the first.

Rob S started it! I always thought AMTs were cash dispensers; until I was informed it was an act of supreme feminine benevolence, normally visited upon the fortunate recipient upon birthdays and anniversaries....

If there is no legal case does he just call all sides dicks and tells them to get out and nobody is getting anything?

Put in common sense terms though, tit for tat is about right, isn't it?

If from your POV you have a ridiculous legal case brought against you, you want to try and force a resolution of it beforehand to stop the hassle (a ridiculous counter claim applies pressure there) or aim high in the hope you can settle for a score draw.

It's not really the wrong thing to do. If the initial action is justified they'll win, if it isn't... they won't. Likewise for a counter-claim.

Anyway, watch Judge Judy, she'd save us all a lot of time and money!

Evidence already submitted as part of skeleton arguments submitted prior.

All this is about judge being able to make a decision based on that plus AEHC barristers submission this morning.

Sisu QC wants to call PKH and Harris to the stand, judge might not think he needs to hear it.

Evidence submitted so far should still get out in public (inc. Emails)

Everybody wins? 29k to AEHC, emails in the public domain.

Seems to be coming up to final furlong...

That's made me laugh, lends itself to a cracking 'Disgusted of Tunbridge Wells' letter to the Torygraph about how standards have slipped

@TheSimonGilbert: Contract law being discussed in depth. This is a slow process. Expecting half a day per witness when we get to them. Could be a long trial.

Maybe they're using lawyers in the same style as the 'run back goalie' you'd have when short of numbers when having a kick about at school? Hard to track exact numbers...

so if sisu loose will they appeal or just take it on the chin and carry on with the counter claim as a defence?

I think I agree with what Rob S has said, I wouldn't be surprised if they settle
