What I meant is why would it even get as far as court? Surely if all of these court cases are rubbish and without reason then SISU should be done for wasting the courts time?

That never happens though does it, not just in SISUs case but generally? It will get to court unless Higgs agree some settlement, in all likelihood the jugde will go 'this is a waste of time', have a dig at SISU's lawyer and award Higgs costs.

This seems far fetched even for SISU and what they are claiming doesn't tie in with the facts we do now, not that we know it all by a long shot. Even if Higgs did what SISU are claiming it still doesn't really follow that they should cover SISUs costs. Isn't Fisher the one always going on about having to leave more than one option open?

I agree that the law needs to be changed to rebalance the legal system.
This is sisu's speciallty, they know sod all about football, but loopholes in the law , they are clued up to the max.

Suing a charity to avoid a £30k debt is ok - do you really think so?

Of course it isn't if they are in the wrong and broke the agreement but then again if they broke the agreement then the charity will have all of the contracts so SISU won't really have a case.

The thing is that until a Judge says "There is no case to answer" it doesn't matter a kipper's-cock what anyone says about whether there is a valid case or not.

But, its what they do - they waste other peoples time and money in legal process and preventing them getting on with the job they are meant to be doing. expect a fair proportion give up because the fight isnt worth it. Ive no doubt SISU will win in the end and get the Ricoh. Whether it is used for the benefit of the club or its fans i doubt it - but we'll see.

The system does not care what is a waste and what is fair use.

As long as you are willing to pay, you can sue anyone you want, for any reason. It might be a waste of everyone's time, but all the major players in the pantomime of court get paid by one side or the other.

There are many reasons why you might sue, only one of those is because you have been wronged.

It is a tactic used by many businesses to force their will on lessor groups. It is so common that it clogs up the legal system and is the reason that things like Judicial Reviews take months to get a Court date.

Cases can run for years until money runs out, or as in 'The Castor Holdings case' in Canada, the highest Court in the land refuses to allow it to be reopened (case started in 1992 and ended about 6 days ago). The worlds longest running Court case is a land dispute in India that started in 1878 and as of March 2013 had still not ended (Doshipura court case).

These examples are of course not in the UK legal system. The longest running UK legal case is the McDonald's Corporation v Steel & Morris [1997] EWHC QB 366, known as "the McLibel case" The original case lasted 10 Years (The battle between them lasted 20 years in total).

Surely there would be a point then they say "Do one, you are taking the piss" if they never had a case?........................................................................SISU take firms to litigation, Higgs would have to pay their own Lawyers(Cost)....How would a Court know their time was being wasted until the case BEGINS? A court cannot throw a case out until it has been heard otherwise it would be claimed as "Presumptive" by SISU.

SISU could be counter claiming hoping to force last minute deal outside of court. It's like the insurance company who kept offering me way below my claim, probably hoping I would accept it and go away.

Then on the day of the court hearing at court they offered me what I wanted. I took it and no court time was wasted. I could have let the case go ahead but ran the risk of whether The court would award me more or even less.

Nick you do seem very naive about these things.

Depends on how the Judge rules in the case, and some judges are well known for passing comment on situations that are unjust, yet legal.

That however requires waiting for it to occur, so better to ridicule each others opinion months before anything is really known.

For a while now we have known Higgs are suing SISU. This is for the legal costs incurred by Higgs when dealing with SISU's attempt to buy the Higgs share of ACL. This was, we are told, what was agreed with SISU, that they would cover all costs. SISU walked away from that deal and have since not paid the costs. Todays article shows that to be £30K.

SISU are now suing Higgs for a six figure sum as they say they couldn't complete the deal and it was Higgs fault. This claim seems to have very little basis in fact, at least the facts that are publically known and the timeframe for what SISU are claiming happened doesn't fit in the timeline of events already known.

sisu seem to walk away from alot of things dont they? rent, fans, ricoh etc and any sense of morality...

Thing is, everyone assumes sisu are in the wrong just because they are sisu. They aren't necessarily in the wrong all the time.

Let me put another way for those who take a little more time... SISU WILL have the better lawyers so it will not be a level playing field. And, contrary to what we'd all like to believe, it never is.

Who is suing who here?

Basically what I'm saying is. Some people are saying Sisu are scum for suing the Alan Higgs, but some people are saying Alan Higgs started the proceedings.
Which is it? Because everyone is being roundly ignored as usual to suit their own arguments.

erm..... Higgs said something, shitsue said something, ccc said stuff , ccfc is fucked <<<< repeat x a million
