Even if CCC did plan to sell the debt to Sisu, what's legally wrong with changing their mind?

obviously nothing was signed or agreed. Is it illegal to find a better option?

(of course assuming the JR finds the loan was legal)

Higgs sued first. Just saying like.

Thats not news. PWKH said they're suing ages ago and that's why they won't talk to Sisu until the deb is paid.

If they do and I wouldn't blame them if they did it's bye bye CAT 2 status

Edit: Ignore that, just seen the response from OSB58

Yes the JR another court date. Great...we will have more court dates than football fixtures soon and might as well put legal team signings on the website as opposed to players becasue SISUs legal squad is bigger, better paid, and better supported by them than the team.

A lot of the back & forth about who said & did what in whatever negotiation/meeting/downstairs toilet has never really come out properly in public. These actions (sue & counter-sue), if they end up in court*, will mean that what happened with the ACL/Higgs/CCC/Sisu rent deal that got called off will be discussed in open court where every single protagonist will be legally bound to tell the truth, the whole truth etc."

In my opinion, that's unfortunately not always what happens in court. Sometimes, in court witnesses have distorted recollection of such meetings. For example in 2005, a High Court judge stated:

"Ms Seppala was the least satisfactory of all the witnesses. In making my general comments above, I said that no-one was deliberately lying. But I fear Ms Seppala has a distorted recollection of some events – particularly about what happened at the meetings in New York in January 2005 – and, with the benefit of hindsight, has introduced a "spin" (I am sorry not to be able to find a better word) which suits the Applicants' case. She is also prone to exaggerate – the Respondents would characterise it as lying, but I give her the benefit of the doubt on that.................

I think that proves my point. She got called out by the judge and it's written in documents we still have access to. At the moment, a lot of what is known is based on the conflicting output from the various sides involved, their PR companies and supporters. People can pick whoever they want to agree with and make up their mind based on that.

With a court case, every side & every possible person will be placed on the stand to be quizzed by both sides' barristers, just as would happen with a full investigation.

It might not be pretty, it might not be quick but, at the moment, this seems like the best route to the actual truth rather than what different people might want to be the truth.

SISU agreed a contract with higgs to repay the expenses the charity incurring doing what sisu wanted should sisu not purchase their half of ACL. SISU didn't Purchase and didn't pay what they had promised so Higgs put in a claim. Thats a million miles away from the lawsuit that sisu have just issued against them.

Just saying like (I've never seen or heard of anyone making a valid point at the same time as saying this. It's a bit like End of.)

So Higgs charity sought to recover money legally owed to them by sisu for nearly 12 months via court proceedings...
And acl initiated court proceedings to recover money legally owed to them by sisu for nearly 12 months.

Yet sisu respond by counter court action saying that the Higgs charity and acl are in the wrong...
Mmm.......

I think most people worry about an organisation who makes it's living in court and two public bodies who don't matching up. I'm not sure it's a fair fight and I'm not sure it would lead to any "truth" coming out.

I imagine a lot of people will be having those exact same thoughts. Another massive PR own goal by SISU, God knows who is advising them. It is though they have got a death wish. They have become so consumed with hatred towards the Council/ACL they seem to have taken leave of their senses. Even if they were to win their various court battles which doesn't seem likely, it will surely end up a pyrrhic victory, as fans continue to turn their back on these clowns.

We used to run the club in a vacuum years ago.

At least we did when we had Paul Dyson here.

Whilst I don't for a second believe you're incorrect I do find it odd people seem shocked by this. Like anybody who has come near the club in the last 15 or 20 years or will after Sisu, they don't give a shit about the fans, it's about making money.

You want a club run for the fans then you need the German model where companies can only buy a percentage, overall controlled is retained by fans in the form of a membership. Given that's currently a million miles off the current English model though it's a pointless conversation.

We got in the shit before by spending money we never had trying to stay in the prem. Now we are in the shit because of trying to make money for hedge fund investors.

God I miss the old days... Standing in awe at the brilliance of Cedric Roussel.. England's number 1 in goal, Stephen Hughes.... The piss on the West Terrace... The pre-match ramble in the Colin Campbell... (Ask your Dad!)

And talking about football.

Is there no end to this shit. Fuck off wankers and let me watch my team in peace.

You are missing something. SISUE suing Higgs for a 6 figure sum for being a part of ACL that refinanced loan. So why the f£ck don't they sue the council? Is it because they are bigger than SISUE?

Well in that case there will be a barrister and enough other people with proper recollection to hang her out to dry. The only time that would fail is if it was just her and one other person in a meeting/situation and I doubt that has ever happened WRT CCFC/Ricoh meetings.

Just trying to figure out without being a lawyer.

When negotiations opened SISU said if things don't go through with the sale, they will cover Higg's costs
Things broke down
Council did the loan
Higgs start action to get the costs
SISU did a counter claim saying that Higgs is in with ACL so they must have known the council agreement was going to happen so are trying to counter claim their own costs back?

Is that the jist of it?

The jist of it is the Sisu hedge fund is suing a Coventry Charity for £100,000+....

"The Alan Edward Higgs Charity benefited from Higgs's entire estate of approximately £26 million. It was set up specifically to help deprived children from Coventry and within 25 miles of Coventry. Higgs's son Derek Higgs, who was knighted in 2004, and his daughter became the trustees. The charity has given millions of pounds to good causes over the years'

Honest question here... Would you rather nothing came out? As I said earlier, until we get a full inquiry, public legal actions could be our best bet.

IMHO, it's one thing to win or lose in the court of public opinion but totally different in an actual court where people & organisations can get fined or imprisoned and the supporting statements & documents are discussed publicly.
