How much of that would Wasps actually be liable for? From the time they've owned ACL? Would that mean Higgs and CCC would have to pick up the balance?

"Successful appeal could cost council big

We're all done here at the Court of Appeal.
Sisu legal team seem pretty pleased with that result.
The implications for the council, ACL and Wasps are potentially huge.
Sisu's legal team seem to believe the Wasps loan could be overturned.
Compensation figures involving many 0s are also being thrown around in conversation outside the court room.
Were talking a "substantial" amount of millions - possibly into the hundreds.
Reputation damage, loss of points, loss of earnings through being forced to move grounds are all likely to form part of the formula.
But of course, they would need to win the appeal to get that far"

So what's the new information that Sisu have given that makes the Judges believe they may be able to over turn the original verdicts? Any suggestions to what the smoking gun may be?

The way the whole sale to Wasps panned out won't have helped the councils defence and must have helped Sisu's case.

Wasps were aware of the pending legal action when they took over ACL so unless a deal is in place for CCC and Higgs to cover any payout it would be down to ACL to pay and if they don't have the cash then Wasps as owners to cover it.

It will mean the bail out loan to ACL which remained in place after the sale of ACL to Wasps.

Same thought has crossed my mind on more than one occasion. Although a JR is only supposed to deal with things as they stood at a certain point in time if SISU can somehow drag the sale into it then CCC don't get shown in a very good light. If they can get the sale into the JR then we might finally get some detail on what actually happened and when the whole process started.

If, and its a huge is as all they have is the right to appeal, SISU could make a solid case they now have no other choice but to build a new stadium I wouldn't be surprised to see them try and get CCC on the hook for that as part of a compensation package.

The judge could have dragged it out a bit longer. We'll have to go back to moaning about not signing Messi now.

I wonder if they'll get any of the stuff they've asked for barring the interest rate. On the case of having to move grounds is that going to be easy to prove? The council could I suppose point to the fact that a deal was struck with that nice man Mr Appleton to finish the season at the Ricoh as proof that Sisu weren't forced out. Or they can ask Sisu to show some evidence that they were evicted/refused the chance to play at the Ricoh the following season.

Sabotage is going to be interesting to prove, I'm assuming they're talking about buying the mortgage on the cheap. But I thought that was covered in JR1/the Higgs case and it was determined that the Yorkshire Bank wouldn't sell it for anything like the sum Sisu proposed.

Adverse publicity? Not sure how that's going to be quantifiable let alone provable but will wait to be enlightened in October. Just wish this was all over quickly, ideally before the new season.

Now would be the best time for Sisu to go to wasps for a deal. At the moment they've got the upper hand but still haven't won the appeal or are they going for broke?

Advertising and sponsorship as well. They could also claim being forced to move has had a detrimental effect so even though they are now back at the Ricoh they are still losing money.

Not sure who that would benefit most, SISU or CCC, but if its covering a lot of the same ground it would make sense and would hopefully mean the whole thing is over quicker. The other option would be hearing the appeal first and if SISU fail starting another JR from scratch which as we know could take years.

Aren't CCFC listed as interested parties (or something like that) in the case? Would that mean a portion of any compensation would be paid direct to the club?

Well maybe but to do that surely they've got to be able to prove that they were told that they couldn't play at the Ricoh. Will be interesting to see if they can do that, probably won't have helped that the club moved themselves out of the stadium.
