So, it's a complaint direct to the European Commission about whether the council acted against EU law. This isn't a court case, so no further legal costs to any party. Reading the blurb on the EC site, there's no way to claim damages other than via national courts, and as it stands that route has been exhausted.

The risk here would seem to be to the Council directly, being exposed as failing to follow EU law. Maybe if the Commission found that true, SISU could start another case in the courts for damages against CCC but that seems a very long way away, and with an even slimmer chance of Wasps being directly impacted.

I have serious doubts that it'll get anywhere, given the scrutiny it's already had from the courts here...

The route in national courts hasn't been exhausted - there is still the potential for civil action against Wasps or the Council (or even Higgs Trust), but that would only have a reasonable prospect of success (in my view) if the EU Commission found that they had acted illegally under EU law.

But i agree, Duffer, that it might not progress if the EC's preliminary investigation deems that the UK High Court and Supreme Court rulings have addressed relevant matters of EU law. But would SISU then appeal *that decision* to the Court of Justice for the EU (they can't appeal the original JR decision to the CJEU because UKSC refused them leave to appeal the case to them)?

So as it stands there is no actual reason why negotiations can't continue or am I missing something?

How can somebody in Brussels stop us playing football in a stadium in Coventry?

I'm going to hazard a guess that SISU take their legal advise from lawyers and legal experts rather than football fans :woot:

I'm not suggesting otherwise. However, the expectation levels given by said lawyers are likely to be misleading do you not think? As with any form of consultancy, legal advise is a results business and if you're not getting the results yet still remaining to provide regular council then surely SISU are being fed the dream. SISU may consider their case to be completely airtight but that confidence will be drip-fed from somewhere.

All we know (only based on rumours) at the moment is that this is a non legal investigation undertaken by a European body, not sisu, that started in February.

If the talks break down because of this London Wasps deserve all they get.

Stuff like that is one of the reasons I'm glad I'm not in the city. I don't think I'd be able to stop myself having a go at the franchise supporting cunts when they pipe up.

Rarely see wasps supporters in Coventry, see 1 or 2 twats walk around with a wasps cap or a wasps t shirt but it's extremely rare, at least over tile Hill Canley way.
On visits to the city centre I rarely if ever see anything wasps related

yup. only time i see them is when wasps game on around holbrooks

i do feel like winding down window and calling them traitors.

Because of a complaint by sisu. One undertaken in February and as such should have been a barrier to talks beginning if they were an issue so in no way a credible reason for talks breaking down. Red herring.
You’re right, as long as they knew about it prior to the talks beginning and were prepared to go ahead with the talks anyway.
Could Wasps, as part of their negotiations have tried to get SISU to drop that complaint and failed hence the impasse now?

(This guy has an Axe to grind with the clubs owners) This is engineered to Alianate the public against SISU-CCFC!. By the reaction of some fans on here it seems to be working, I was in the Pub last night and listening to punters having a right old rage at SISU about it and I explained that its not the European Court of Justice they said that Gilbert didnt say that on his Twitter! I said "My point exactly the Guy is a shit stirrer of the highest order" he is working on the fact that he sees most of his followers as morons and will not know the difference. Does anyone know how to investigate the European Commision site to find its source etc! Wonder if Reid is looking into it for the Coventry Observer

Luckily if you live in Coventry you never see them!

Think a lot of people that watch them are from Birmingham or Warwickshire surrounding areas plus their hardcore London based fans, can't imagine they get much more than 2-3000 a week actually from Coventry

He seems quite quiet these days! Maybe he doesn't want to get embroiled and is respecting the NDAs quoted?

I don’t know really as I don’t know how the commission works?
I mean if someone made a complaint to the Police and then the victim withdrew the complaint, the Police would normally stop investigating. (Depending on the seriousness of the crime).

Who benefits? It's hard to see it as being in SISU's interests, mid-negotiation.

The only other party who should have been aware of it would be the Council, after being asked by the EC for a response.

So either SISU leaked it, to scupper the talks for reasons unknown, or someone at the Council leaked it, in order to alert Wasps and encourage them to pressure SISU to drop it.

I know which one of those looks more likely to me... If so, would that not represent a failure in a duty of confidentiality from a Council officer or representative? Hmm.

In public life, sometimes it's the cover-up that gets you, rather than the infraction!

For a club that now claims to have been nomadic and close to going out of business without their own stadium the way their fans relish the problems facing the football club says a lot about rugby supporters.

Even our biggest rivals, well apart from Sunderland with their made up rivalry, don't want to see the club forced out of the city or cease to exist but this lot can't wait and are encouraging Wasps to stick the knife in.

Well the council would have told the franchise when they were first notified.
No need to talk about while talks were ongoing.
Talks stall and they need some PR spin.
They both reveal this to various people who then pass it on to Gilbert.

It's clear as day who is trying to play us here.
