What a bunch of drama queens. Wishing someone a slow and painful death, cancer of our club. FFS they always said they were going to appeal. Its not really news is it? What is news though is Mr Gilbert's tweet about it being no barrier to negotiations. That's got to be positive surely.

It appears that SISU are very much a one trick pony in their approach to negotiation.

"Play hardball", "batter the other side" etc etc. that's fine if you win, but that seems to be less and less likely as the days go by.

Will there come a point at which they see the need to build some metaphorical bridges?

As Einstein said, the definition of insanity is to carry on doing the same thing and expect a different result.

I hope that in parallel to this disappointing news, they are talking to ACL and stressing that they will be keen to drop the appeal if a settlement can be agreed - and I hope that, if so, they are being realistic about what might be achievable.
That's my hope. It would explain the last minute nature of it too....

Not really unexpected is it

TF can try to distance the club from the legal action but it doesn't really stand up to scrutiny really does it. The two entities named on the court documents are ARVO and SBS&L who are the only share holders in Otium trading as CCFC. The only reason they can attempt a legal challenge is because they own Otium. He is trying to point attention in another direction (an old and oft repeated SISU tactic) and say "not me guv". Bottom line is that SISU and CCFC are inextricably linked at this point - they are not two separate things. Therefore CCFC is absolutely involved in any legal action - it is, has always been and remains the tool to an objective

Clearly there is a clear split however between the needs and intentions of SISU/ARVO/SBS&L and the needs of CCFC. Unfortunately I don't see how you split the involvement in all aspects of this for all of those four though. Not only that but the only one who makes decisions for all those entities is JS. Nothing gets agreed unless she says so ..... rent deals, returns to Coventry, fantasy ground builds and above all legal actions. So this TF idea of separation is to be honest sheer bunkum

ACL certainly had input in to the FL decision however there was no power held by them to accept or reject the £471k - they were not nor ever were part of the contract between FL & Otium. Therefore they had no choice in accepting the £471K to imply they did is wrong. I wonder if the FL have paid it over yet?

I am not sure they will, but there may be a chance that ACL will see beyond this latest court action and negotiate to a conclusion that brings the club back now. But I suspect they wont be inclined to after this. From their point of view why do they need to include as part of negotiations whether or not legal action continues. They have said clearly all the legal actions have to stop. I would suspect at this stage they feel confident the appeal will be rejected and their need for CCFC to be back is less than the need CCFC has to return. Is this the only legal challenges going on?

What this does do even if ACL negotiate is to harden what is going to be on offer. It will only ever be a rent deal and with the other legal distractions there is no real incentive for ACL to jump through hoops in negotiating rights to income etc. No rights to income or agreed costs for using those income streams and the decision maker at CCFC will reject any deal, most likely stating a refusal by ACL to negotiate as the reason ...... but will it really be the case? or has any negotiation been set up to fail in the first place and the objective remains as it always has.

As they say leopards do not change their spots

Altogether disheartening ............ interesting to see how this latest news affects the travelling support "home" or away

How long will the legal process for SUSU/ARVO to challenge the JR in the EU courts drag on, 2, 3, 4 years?

It will happen... do not think otherwise, the ARVO legal man Alexander Carter Silk as much as said so to a CWR reporter.

If Simon is correct and this appeal won't stop negotiations then common sense has prevailed from at least ACL's side I think. Just have to hope it is contagious if they meet to discuss!

Will copy and paste this post, print it and frame it ;)

The feeling I have at the minute is like trying to tell some one the sky is blue, while they are adamant its green. :(

It's only the same fate as she's inflicted on our club Mark ;) should we be surprised? No...but are we? Yes. It's beyond belief. They must have money to burn. The amount they've pissed up the wall could've got us back to the championship at the very least or probably gone some way in purchasing half the ground.

Yes Simon's tweet is intriguing but I can't comprehend how it isn't a barrier. ACL clearly stipulated 2 provisos before any talks could be entertained. Why would they need to back down on the second one? They're firmly in the driving seat in this tedious saga, and have recouped a hefty sum to the tune of almost £500k. If Scrotium can't batter people in the High Court, they certainly won't in the Supreme Court.

Perhaps negotiations have taken place behind closed doors already?

I suppose the real tragedy now I think about is that even if we come back to the Ricoh there will be no fairy tale. As football fans we are impaired by ingrained values, and we can not really comprehend the cynicism of our owners view. Even now we debate football topics when really they are secondary. There will be no influx of players, no investment in the team or infrastructure as these will never be key to our owners goals. I understand why people cling on to the club, to us fans football is about more than legal negotiations and disputes, however there is no point or value that I can see in continuing to follow an entity that attaches no value to your support or loyalty.

Yup, if only people could see more clearly what is going on.. why do the minority just accept the abuse of their loyalty..

I have always said play in Cov and I will be there regardless of who owns the club as I always was until the dark day in 2013 when the move happened. The problem I have now is its not possible to think of the club without the stain of SISU. Until they are gone I will find it hard to watch them play even in Coventry.

It makes sense that both sides carry on as they would have until agreement is reached. It absolutely should not be a barrier. Its a bargaining chip and pretty much the only one SISU has left.

Where is Mr Labovitch to make a statement about this on the radio this evening?

I agree although it would have been nice if they hadn't and had sat down with ACL on Monday morning.

Assuming Simon is correct, ACL weren't in a position to quibble on the amount the FL decided on and would have had to accept whatever amount they came up with. I'm not hopeful sadly.

As has been clear all along it is the only bargaining tool they've got. Otherwise, to be frank, they're at the mercy of the not so generous ACL.

I'm not sure it will. All they have done is asked for permission to appeal, not a lot of legal work there. If negotiations are ongoing a deal could be done long before any further court appearance.

Who paid for the Judicial review and all the leg work to get there in the first place? That includes the attempt to have the novel, sorry essay by Joy introduced into evidence just before the JR and the initial hearing where it was thrown out, and the one where they were told the JR could go ahead. No such thing as a cheap barrister someone once told me.

I worry that they (or rather she) don't know it. There's this appeal and can't they go to the European Court as well?

As for how they get out if they do realise they've lost, I suppose you sell up for whatever you can get.

Or liquidate :( that's my worst fear.

I'd rather steadily rebuild, than loose the original CCFC :(

I meant they've lost in terms of the whole Ricoh/Sixfields bollocks. They've blinked first. Everyone knows they won't build and they need to return hoping that nobody spots their tail between their legs.
As for an exit strategy, that may be a long way off.
